K. White Stivers Dir.Public Wks. Geo. Marr The regular meeting of the Burlingame City Planning Commission was called to order by Chairman Roy Henderson, at 8:05 P.M. on the above date. The minutes of the regular meeting of December 27th, 1954, were corrected and approved. FIRST ORDER OF BUSINESS: The reclassification of Lots 10, 13, and 14 - Paloma Avenue, Easton Addition, from R-2 to R-3. These lots already have apartments on them. Mr. James Himmel, 1421 El Camino Real, was of the opinion that in making this area apartment zoned would jeopardize the Broadway Dis- trict from growing. He felt that if there were apartment houses on these lots, they could not be used for future business lots as easily as if they had homes on them, which could be torn down more readily to make room for business. Chairman Henderson replied that he was of the opinion that if there were apartment houses on these lots it would help bring more busin- ess to the Broadway area. Planning Commissioner Simonds made a motion that the City Council be recommended to reclassify Lots 20-13-14 - Paloma Avenue, from R-2 to R-3; seconded by Commissioner Martin and unanimously carried. SECOND ORDER OF BUSINESS: Tentative map covering resubdivision of Block #6, Mills Estate #3. Planning Consultant Mann explained that a tentative map should show complete tentative dimensions, sizes, etc., on the entire map submit- ted. The matter was discussed at the study meeting as a resubdivision of the entire Block #6. The purpose of the tentative map is to show the Planning Commission and the City Council how the property is to be used finally. This tentative map submitted to the Planning Com- mission does not have all the dimensions, sizes, etc., on Lot #8, merely dotted lines. Planning Commission Minutes - Jan. 24, 1955 rage 3P4• Chairman Henderson expressed the opinion that the Planning Commission should not act on this tentative map because it was not complete. Planning Consultant Mann expressed the opinion that if the Commission cares to pass on the tentative map now, then a substitute map should be prepared eliminating all of the dotted lines in Lot #8 before going to the City Council. Lot #8 covers the entire central portion. Planning Commissioner Martin made a motion that the tentative map pre- sented be approved by the Planning Commission with the removal of dot- ted lines in Lot #8 before it is presented to the City Council, second- ed by Commissioner Diederichsen and unanimously carried. Planning Commissioner Simonds made a motion that the City Attorney and City Engineer be asked to cooperate and see that the dotted lines are removed from Lot #8 before it is submitted to the City Council. UNFINISHED BUSINESS: The unfinished building on the property of Al Marion, 1213 Mills Avenue. Planning Commissioners who looked over the building reported that the structure had the appearance of an apartment. Mr. James Himmel requested a resume of the history on the building in question. Mr. Watson reported that a building permit was issued in August of 1950 for a garage; and within 30 days a verbal permit was given to permit a rumpus room on top of the garage. At the study meeting, Mr. Marion had presented a letter from the City Council giving him permission to build a rumpus room. He admits that he could make this into an apartment if the area was changed to apart- ment house zone. Planning Commissioner Mitchell questioned why the work was stopped on the building after he had received the letter from the City Council giving permission for a rumpus room? Building Inspector Watson explained that work was stopped on the structure because the building was being erected like an apartment house. Mr. Marion would not take out the partitions, and the Build- ing Inspector would not allow him to continue the work. Planning Consultant Mann stated that since the last meeting, City Clerk Herbert K. White has gone over the City records and found more data on this matter, and suggested the subject be laid over until next month and have the City Clerk bring all this material before the Planning Commission. City Attorney Karmel was asked to give this matter further study. Councilman Rooth suggested that the Planning Commission try to arrange a meeting with the new park Commission and discuss the matter of cer- tain new parks in the new Mills Estate Subdivision and City owned tidelands. In the event this is arranged, there will be a Council representative at the meeting. Planning Commission Minutes - Jan. 24, 1955 Page #3 Planning Commissioner Simonds replied that the authority lies with the City Council and they should arrange the meeting. He suggested that the Planning Commission communicate with the Park Commission, at the request of Councilman Rooth, that the Planning Commission, Park Commission and City Council meet to discuss parks. Amendments to Zoning Ordinance to Section 1926 by adding a new para- graph to subsection "a" to read as follows: 4. Offices of physicians, surgeons, dentists, chiropractors, drugless practitioners, and members of similar occupations, when operated in conjunction with their respective dwell- ings. Repeal paragraph 3 of sub -section B of Section 1928 and renumber the following paragraph from #4 to #3• Mr. H. Rosaaen, 1440 Carlos Avenue, said he moved to Burlingame with the thought that he was choosing a beautiful and pleasant city. He believes that a line should be drawn to prevent practice in their homes. Mr. Platt stated the Improvement Club was against allowing offices in own homes, and Mr. Fred Lehman stated the Improvement Club Council is very much opposed to any change in this ordinance. Commissioner Simonds made a motion that'the City Council be notified that the Planning Commission have studied and held public hearings and recommend that the Ordinance should not be changed; seconded and unanimously carried. Application for a Variance and Use Permit for the construction of a Service Station at Rollins Road and Broadway on the property owned by Alfred DeVries. Planning Consultant Mann stated that this whole matter was held up because of the proposed extension of Whitdhorne Way. Planning Commissioner Martin questioned Mr. Hunter, Attorney for Mr. DeVries as to whether it would aid him if the Planning Commission were to approve the Variance permitting the erection of the Service Station within 490 feet of another station, and hold up the Use Per- mit until they actually have a lease - which would allow them to nego- tiate with the oil companies before asking for the Use Permit. Planning Commissioner Martin made a motion that a variance be approved and the Use Permit be postponed until such time as necessary and plans can be submitted, seconded by Commissioner Mattock and unanimously carried. NEW BUSINESS: Planning Consultant Mann reported that at the last meeting of the City Council there was some discussion of the question of elapsed time of resubdivision in the industrial areas. TYn Industrial Com- mittee is holding a meeting on Wednesday night, January 26th, and the Council has asked Director of Public Works Marr, City Attorney Karmel and Planning Consultant Mann to be present and discuss the possible changes in the resubdivision Ordinance or the possibility Planning Commission Minutes - Jan. 24, 1955 rage #4 of speeding up the matter itself. Commissioner Henderson was asked to attend the meeting to represent the Planning Commission. Planning Consultant Mann also suggested that it would be helpful to hold a half hour session before the regular Planning Commission meetings to take care of questions and advise proper procedure to those people who may request help, etc., and it was decided that the Planning Commission try out this plan at their next regular meeting, allowing the period of 7:30 to 8:00 P.M., and commencing the regular meeting at 8:00 P. M. It was also decided to commence the study meetings at 7:30 P. M. instead of the usual 8:00 P. M. There being no further business, the meeting was adjourned at 10:30 P. M.
