DENYING THE CITY AND COUNTY OF SAN FRANCISCO
PERMISSION TO CONSTRUCT AND OPERATE A WATER
PIPE LINE ON CORTEZ AVENUE, DEVEREAUX DRIVE,
RAY DRIVE AND MARCO POLO WAY IN THE CITY OF
BURLINGAME
WHEREAS, the City and County of San Francisco through
the office of Director of Property, on March 8, 1951, applied
to the City of Burlingame for permission to lay a water pipe line
on Cortez Avenue, Devereaux Drive, Ray Drive, Marco Polo Way
and on a ten (10) foot lane in Devereaux Drive to Ray Drive, all
in the City of Burlingame; and
WHEREAS, the City Council gave notice of the time and
place of a public hearing upon the application, which said meet-
ing was held on April 9, 1951, at which said meeting all persons
interested in said matter were given an opportunity to be
heard; and
WHEREAS, at the meeting on April 9, the City and County
of San Francisco was represented by the manager and engineers
of the Water Department and at said hearing a complete and
thorough discussion was held as to all of the relative merits
and demerits in connection with said application and the proposed
installation of water lines on the streets above mentioned; and
WHEREAS, the City Council announced at the conclusion df
the meeting on April 9, that it would render a decision on said
application at the regular meeting of the City Council to be
held on April 16, 1951; and
WHEREAS, the City Council, after mature consideration
upon the application above mentioned, came to the decision
hereinafter mentioned.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
of the City of Burlingame, that the application of the City and
County of San Francisco for permission to construct, maintain
and operate water pipes on Cortez Avenue, Devereaux Drive,
Ray Drive, Marco Polo Way and a ten (10) foot lane from
Devereaux Drive to Ray Drive be, and the same is hereby
denied;
BE IT FURTHER RESOLVED and it is hereby recommended
that the City and County of San Francisco make the study of
other ways and means for the construction and maintenance
of the proposed grater lines carrying water from the reservoir
in San. Mateo County to the City and County of San Francisco.

CITY OF BURLINGAME
SAN MATEO COUNTY, CALIFORNIA
Resolution No.
RESOLVED, That the City and County of San Francisco, a
municipal corporation, its contractors and agents, hereinafter re-
ferred to as the permittee, is hereby granted permission to construct,
reconstruct, maintain, operate, repair and/or remove a water pipe
line (not exceeding 60 inches inside diameter) in or across certain
city streets, situated in the City of Burlingame, County of San Mateo,
State of California, as shown on San Francisco Water Department Map
No. R-224 as follows:
In Cortez Avenue, from the southerly
side of Sanchez Avenue, to the northerly
end of Cortez Avenue.
In Devereaux Drive from the northern pro-
longation of Cortez Avenue to a 10' Lane.
In a 10' Lane from Devereaux Drive to
Ray Drive.
In Ray Drive from the 10t Lane opposite
Lassen Way to Marco Polo Way.
In Marco Polo Way from Ray Drive to the
northerly side of Davis Drive.
This permit is granted subject to the following conditions:
1. Said pipe line shall be laid below the finished surface
of said City streets to a minimum depth of two feet; provided, how-
ever, that appurtenances may be constructed flush with the surface
of the roadways.
2. During construction of the pipe line, the permittee shall
maintain suitable bridges over the trench to take care of traffic.
The permittee shall hold the permitter free and harmless from all
claims for damages or injury to persons or property resulting from
accident due to the construction, reconstruction or repair of said pipe
line along said City streets. If any existing sewers, water pipes or
other structures of other parties laid in said City streets become
injured due to any operations of the permittee under the terms of this
permit, they shall be repaired immediately by the permittee at its
own expense.
3. After completing construction or other work on said pipe
line along said City streets, the permittee shall restore the streets
to their previous condition to the satisfaction of the permitter in
accordance with City of Burlingame specifications.
I hereby certify that the foregoing resolution was adopted by
the City Council of the City of Burlingame at its meeting of
