Sperry, Jr., co-partners, doing business under the firm name and style of Sperry and McCue, for the improvements of park recreation areas pursuant to the specifications dated April 21, 1952, be, and the same are, hereby accepted. BE IT FURTHER RESOLVED that the City enter into an agreement with the aforesaid parties for the purpose of author- izing the said work to be performed and completed, and the Mayor be, and he is, hereby authorized for and in behalf of the City of Burlingame and the City Council, to enter into an agreement therefor. McCUE, CO- PARTNERS :DOING BUSI T ESS UNDER T-HEc FIRM NAME AND STYLE OF S PERRY AND McCUE This Agreement made and concluded this ?,qt-4day of April, 1952, by the City of Burlingame, a municipal corporation, party of the first part, and Vred D. Sperry, Jr, and Owen D. McCue, co-partners, doing business under the firm name and style of Sperry and McCue, herein designated the contractor, the party of the second part.:,, WITNESSETH: ARTICLE I - That for and in consideration of the payments 4nd agreements hereinafter mentioned, to be made, kept and performed by the party of the first part, the party of the second part agrees with said party of the first part, at its own proper cost and expense, to do the work and furnish all the materials, except such that are mentioned in the specifications to be furnished by the party of the first part, necessary to complete in a good, workmanlike and substantial manner, the construction and completion of all recreation park improvements as set forth and designated as Job 52-13 and as set forth in the specifications attached hereto and made a part of this agreement. ARTICLE IV - It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid of the contractor then this contract shall control and nothing herein shall be considered as an acceptance of the said terms of the said bid conflicting here- with. ARTICLE V - The specifications herein referred to and made a part hereof shall be signed by the contractor and for the City by the Mayor of the City and shall be attached to this Agreement.
