HomeMy WebLinkAboutReso - CC - 077-1952RESOLUTION NO. 77-52 OF INTENTION TO CONSTRUCT IMPROVEMENTS CHAPIN AVENUE IMPROVF;MENT PROJECT NO. 52-48 RESOLVED, by the City Council of the City of Burlingame, (California, that in its opinion the public interest and convenience reccu,ru, and. that it is the intention of said Council to order the (following acquisitions and. improvements to be made in said City, to -wit: 1. The improving of Chapin Avenue between Primrose Road and E1 Camino Real by widening said street to a width of 98 feet, by grading including removal of trees, and by constructing therein crushed rock base pavement with asphalt concrete wearing surface, cement concrete curbs, gutters and, sidewalks, the removal of ex -- listing trees and structures, and the installation of an electric i,street lighting system, planting trees, the installation of tele- phone and electrical conduit, and the extension of sewer and water ;services, together with the acquisition o' all rights of way neces- i �sary to complete the same. 2. Whenever any public way is herebWT referred to as running between two public ways, or from or to any public way, the inter- sections of the public ways referred to are included to the extent that work shall be shown on the plans to be done therein. 3. Said, streets andhighways are more particularly shown in the records of the office of the County Recorder of San Mateo ;ounty, California, and shall be shown upon the plans herein re - erred. to and to be filed with the City Clerk of said City. 4. All of said work and improvements are to be constructed t the places and in the particular locations, of the forms, sizes, .ls:"ons and materials, and at the lines, grades and elevations hown and delineated on the plans, profiles and specifications ladopted therefor by the City Council of said City and on file in (the office of the City Clerk of said City. 5. There is to be excepted. from the work above described any of such work already done to line andgrade and marked ex- cepted. or shown not to be done on said plans, profiles and. specifications. 6. Said. Council does hereby adopt and establish as the official grades for said work the grades and. elevations to be shown upon said plans, profiles and. specifications. All such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of Burlingame. 7. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished surface of the improved streets to a grade different from the surface of such streets as they now -exist, and that to said extent said grades are hereby changed. and that said work will be done to said. changed, grades. 8. Said, contemplated acquisitions and. improvements, in the opinion of the City Council of said City, are of more than local or ordinary public benefit and said Council does hereby make the costs and. expenses thereof chargeable upon a district the exterior boundary of which is the coterminous exterior boundary of the lots, pieces and parcels adjoining Chapin Avenue between Primrose Road. and El Camino Real. 9. Said, Council further declares that all public streets, highways, lanes, courts, alleys and public places within said. assessment distr-!_ct in use in the performance of a public funetiot as such, shall be omitted from the assessment hereafter to be made to cover the costs and expenses of said acquisitions and. improvements. 10. Notice is hereby given that serial bonds to represent unpaid assessments, and bear interest at the rate of not to exceed five per cent (5%) per annum, will be issued hereunder in the manner provided by the Refunding Assessment Bond. Act of 1935 as modified in the Municipal Improvement Act of 1913, the last installment of which shall mature fourteen (14) years from -2- the second day of July next succeeding ten months following their date. 11. Except as herein otherwise provided for the issuance of bonds, all the above construction and acquisition shall be done pursuant to the provisions of the Municipal Improvement Act of 1913, as amended. 12. Said proposed acquisitions and improvements are hereby referred. to the City Engineer of said City and E. P. Wilsey Co., Inc., being competent persons employed. by said City for that purpose; and said Engineers are hereby directed to make and file with the City Clerk of said City a report in writing, presenting the following: (a) Plans and specifications of the proposed. improvements to be made pursuant to this Resolution of Intention; (b) gaps and descriptions of easements to be acquired; (c) Engineer's statement of the itemized and total estimated costs and expenses of said acquisitions and improve- ments and. of the incidental expenses in connection therewith; (d) Diagram showing the assessment district above referred to, and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Intention, each of which subdivisions shall be given a separate number upon said diagram; (e) A proposed assessment of the total amount of the cost and expenses of the proposed acquisitions and improvements upon the several subdivisions of the land in said district in proportion to the estimated benefits to be received by such I subdivisions, respectively, from said acquisitions and improve- j I ments, and of the expenses incidental thereto. 13. If any excess shall be realized from the assessment it shall be spent for the maintenance of said aoquisitions and -3- improvements, unless the Council shall hereafter determine that said amount or any part thereof shall be applied as a credit to each assessment herein. • I, Herbert K.
