HomeMy WebLinkAboutReso - CC - 032-1953RESOLUTION NO. 32 - 53 OF INTENTION TO CONSTRUCT IMP'ROVEM_',';NTS ON ROLLINS ROAD FROM BROADWAY TO GROVE AVENUE CREEK AND TO ACQUIRE AND IMPROVE MARSTEN ROAD FROM ROLLINS ROAD To GROVE AVENUE CREEK RESOLVED,, by the City Council of the City of Burlingame., California, that in its opinion the public interest and convenience require, and that it is the intention of said Council to order the following acquisitions and improvements to be made in said City, to -wit: 1. The improving of Rollins Road from Broadway to Grove Avenue Creek by widening said street to a width of sixty (60) feet, and by constructing therein storm drains, catch basins, vitrified clay pipe sanitary sewers, manholes, laterals, cast iron water mains, valves, hydrants, concrete curbs and -utters and concrete sidewalks on one side of the street, and by con- structing therein crushed rock pavement with asphalt concrete wearing surface, cement concrete curbs, gutters and sicewalks,, together with the acquisitions of all rights of ways necessary to complete the same. 2. To improve a private road, to be acquired and dedicated to public use, known as Marsten Road with its auxiliary access road from Rollins Road, to Grove Avenue Creek, by gra6ing, paving and constructing therein storm drains, catch basins,, vitrified clay pipe sanitary sewers, manholes, laterals, cast iron pipe water mains, valves, hydrants, concrete curbs and gutters, concrete sidewalks and all auxiliary work thereto to complete the same, together with the acquisition of all rights o'i ways necessary thereto, 3. `lie said streets and ways are more particularly shown in the records in the Office of the County Recorder of San Mateo County, California, and also shown upon the plans herein referred to and to be filed with the City Engineer and the City Clerk of said. City. 4. All of said work and improvements are to be constructed at the places and in the particular locations, of the forms, sues, dimensions and materials, and at the lines, grades and elevations shown and delineated on the plans, profiles and to be specifications/adopted therefor by the City Council of said City thereafter ands jDm f ilea in the Office of the City Engineer of said City, Said Council does hereby adopt and establish as the official grades for such sa ork the grades and elevations to be shown upon the said plans, profiles and specifications, b. All such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of Burlingame 7. Notice is hereby given of the fact that in some cases said work and improvements will brim; the finished surface of the improved streets to a grade different f°rom the surface of such streets as that now exist, and that to said extent said grades are hereby changes and that said work will be done to 8. Said contemplated acquisitions and improvements, in the opinion of the City Council of said City are of more than local or ordinary public benefit and said Council does hereby make the closts and expenses trhereof chargeable upon a district the exterior boundary of which shall be within are assessment district to be established and shall include all of the lands, lots or parcels thereof to be benefited by such acquisitions and improve- ments and to be delineated by the engineer designated to outline and delineate the assessment district. 9. Notice is 4ereby given that serial bonds to represent unpaid assessments, and bear interest at the rate not to exceed' f i re (5) percent per annum, will be issued thereof in the manner provided by the Refunding Assessment Bond Act of 19,35 as modified in the Municipal Improvement Act of 1913, the last of which shall (mature fourteen (14) years from the second day of July next succeeding ten months following their date. 10. Except as herein otherwise provided for the issuance of bonds, all of the above cons ruction and acquisitions shall be done pursuant to the provisions of the Municipal Improvement Act of 1913, as amended. 11. Said p-op = ed acquisitions and improvements are hereby referred to the City Engineer of said City and E. P. Wilsey, Co., Inc., being competent persons employed by said City for that purpose; and said Engineers are hereby directed to make and to file with the City Clerk of said City a report in writing, presenting the following: (a) Plans and specifications of the proposed improvements to be made pursuant to this Resolution of Intention; (b) Maps and descriptions of easements and private roads to be acquired; (c) Engineers' statement of the itemized and total estimated costs and expenses of said acquisitions and improve- ments and of the incidental expenses in connection therewith; (d) Diagram showing the assessment district above re. ferred to and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Intention, each of which subdivision shall be given a separate number upon said diagram; (e) The proposed assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the subdivision of the land in said district in proportion to thee stinated bere fits to be received by such subdivision, respectively, from said acquisitions and improvements, and of the expenses incidental thereto. 12. If any excess shall be realized fron, the assessment it shall be spent for the maintenance of said acquisition and improvements, unless the City Council shall hereafter determine that said amount of any part thereof shall be applied as a credit to each assessment herein.
