HomeMy WebLinkAboutReso - CC - 066-1954RESOLUTION NO. 66 - 54 RESOLUTION MODIFYING AND CHANGING ALIGNMENT OF ROAD TO BE OPENED DESCRIBED IN ORDINANCE OF INTENTION NO. 560 ADOPTED AUGUST 161 1954; MAKING CHANGES IN PROPERTIES TO BE ACQUIRED THEREFOR; AND DIRECTING PREPARATION OF ORDI- NANCE ORDERING IMPROVEMENTS TO BE MADE AND ACTIONS IN CONDEMNATION OF PROPERTIES NECESSARY THEREFOR. WHEREAS the City Council of the City of Burlingame adopted 2ugust 16, 1954, its Ordinance of Intention No, 560, declaring its intention to order the improvements therein described in the Broadway Industrial Area in said City, including the widening, opening and/or ex- tending of certain roads therein described, and the acquisition of lands and easements therefor and for a drainage pumping station and enlarging a drainage easement, all thereof in accordance with a Map showing the same, approved by said Council and on file with the Clerk thereof, said Ordinance describing the boundaries of an Assessment District proposed to be created to be assessed for the cost and expense of said improvements; and there- after said Council duly held a hearing upon said proposed improvements and Assessment District at the time and place appointed therefor in said Ordinance, and thereupon by affirmative vote of four -fifths of its members overruled and denied all protests theretofore filed against said improvements or the extent of said Assessment District; and WHEREAS said City Council thereafter on October 26, 1954, duly adopted its Resolution No. 64-54, declaring its intention to realign one of said roads to be opened, described in said Ordinance of Intention, and to make certain changes in certain properties proposed to be acquired therefor as so realigned, said realignment and -1- changes in said properties being shown on certain Diagrams filed with the Clerk of said City Council, and said changes being described in said Resolution and in a Notice of In- tention of said City Council to make such changes, which Notice was thereafter published as required by law and specified a time and place for the hearing by said City Council of any objections to said changes; and thereafter said Council duly held a hearing as required by law on said proposed changes, at the time and place provided therefor in said Notice; NOW THEREFORE RESOLVED by the City Council of the City of Burlingame that all objections heretofore filed against said improvements, and said changes in the realignment of said road to be opened and in the properties to be acquired therefor, be and the same hereby are over- ruled and denied; and that said changes in the realignment of said road and in the properties to be acquired therefor be approved and made as proposed in said Resolution No. 64-54 adopted October 26, 1954; FURTHER RESOLVED that an Ordinance be prepared by the City Attorney to be adopted by said City Council ordering said improvements to be made as so modified and changed, and directing the City Attorney, with the assistance of special counsel heretofore employed therefor, to bring actions in the proper superior court, in the name of said City, for the condemnation of the properties necessary or convenient to be acquired therefor.
