HomeMy WebLinkAboutReso - CC - 055-1954RESOLUTION NO. 55-54 AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE SAN MATEO COUNTY SCAVENGER COMPANY, A CORPORATION, FOR THE COLLECTION AND DISPOSAL OF DRY REFUSE, RUBBISH AND GARDEN CUTTINGS WITHIN THE CITY OF BURLINGAME RESOLVED, by the City Council of the City of Burlingame, that the Mayor be, and he is hereby, authorized to execute the attached agreement, for and on behalf of the City Council, and the San Mateo County Scavenger Company, providing for the collection and disposal of dry refuse, rubbish and garden cuttings within the City of Burlingame, for a period of five (5) years, from and after October 1, 1954 H. I: Nona —A�RT 1��W�HITE CITY CLERK AN AGREEMENT BETWEEN THE CITY OF BURLINGAPriE, A MUNICIPAL CORPORATION, AND SAN MATEO COUNTY GARBAGE COMPANY, A CALIFORNIA CORPORATION, PROVIDING FOR THE COLLECTION AND DISPOSAL OF DRY REFUSE,, RUBBISH, AND GARDEN CUT`IINGS, WITHIN THE CITY OF BURLINGAM This Agreement, made and entered into this ?th day of eptember, 1954, by and between the City of Burlingame, a Municipal orporation, the party of the first wart, and San Mateo County a-pba Company, a California Corporation, the party of the econd part WITNESSETH: WHEREAS, the party of the first part, as a municipal ion, and according to regulations prescribed by it, does ause a certain dry refuse, consisting of garden cuttings, and rubbish, to be gathered from the front of .residence properties said city, to be hauled away for disposition, and desires to ontract with the second party for the purpose of such collection and disposition, and; WHEREAS, the party of the second part, engaged in the business of garbage disposal, is agreeable to contract with the first party or the collection and disposal of the dry refuse herein mentioned: NOW, in cjnsideration of the premises and other valuable jeonsideration, moving to the parties hereto, as herein mentioned, the said parties agree; as follows: 1. The party of the second. part hereby agrees to (gather, collect, and haul away, according to regulations as to ime, place, and districts, prescribed by the first party, garden jeuttings, and dry rubbish deposited in containers in the front of Ithe residence properties in said city, for a period of five (5) years beginning October 1, 1954, the compensation to be paid to said second party shall be at the rate of 1,000.00per month, ieh the first party agrees to pay; 2. The party of the second part hereby further agrees furnish any and all equipment necessary to carry into effect provisions and terms of this agreement, excepting garbage and fuse containers, and in this connection the party of the first art hereby agrees to adopt and enforce all necessary regulaticns, to assist the second party in the complete performance of this agreement, and further agrees that the second party shall have rmission to dispose of all such dry rubbish, collected in cordance with this agreement, at the City Fill, at the end of oadway in said City. 3. It is mutually understood and agreed that the pro - ±visions of this contract shall apply to all parts of the City of rlingame and within its corporate limits as the same now exist excepting therefrom Burlingame Manor, Skyline Manor, Burlingview Terrace, Kenmar Terrace, and the Mills Estate. 4* All other agreements heretofore made by the parties hereto, or their predecessors in interests, shall be and the same re hereby cancelled and of no further force or effect.
