A RESOLUTION OF AWARD OF CONTRACT
CONSTRUCTION OF WATER RESERVOIR FOR
MILLS ESTATE NO. 19
RESOLVED, by the City Council of the City of Burlingame,
California, that
WHEREAS, said Council did in open session on August 19,
1963, authorize and direct the City Clerk of said City to adver-
tise for, open and examine sealed proposals or bids for the work
to be done and improvements to be made; and
WHEREAS, sealed bids or proposals have been advertised for,
opened and examined by the City Clerk, the City Manager, and
the Director of Public Works, as authorized and directed; and
WHEREAS, alternate bids were invited for the construction
of a one million gallon pre -stressed concrete reservoir and a
one-half million gallon pre -stressed concrete reservoir in
accordance with designs and specifications prepared for City
and for the construction of a one million gallon pre -stressed
concrete reservoir and a one-half million gallon pre -stressed
concrete reservoir in accordance with contractor's design; and
WHEREAS, THE CROM COMPANY, a corporation, submitted a
written proposal for the construction of a one million gallon
pre -stressed concrete reservoir in accordance with its design
at a total bid price of $76,420.00; and
WHEREAS, said design has been checked, modified, and
approved as modified by the City Engineer of City; and
WHEREAS, said modification of design will increase the
capacity of said water reservoir to one million seventy thousand
gallons at an additional cost of $1,000.00; and -
WHEREAS, the lowest responsible alternate bid was that of
the CROM COMPANY, a corporation, in the sum of $76,420.00;

NOW, THEREFORE, IT IS ORDERED as follows:
(1) That the City Council hereby rejects all of said pro-
posals or bids except that hereinafter mentioned, and hereby
awards the contract for doing the work and improvements and
furnishing the materials, supplies, and equipment necessary
to the construction of said one million gallon pre -stressed
concrete reservoir in accordance with the Bidder's design, as
modified by the City Engineer, to the CROM COMPANY, for the
sum of $77,420.00.
(2) The acceptance of the alternate bid of the CROM COMPANY,
as modified, will result in the performance of the work at the
lowest available price, and to re -advertise for bids would not
result in competitive bidding, would not result in a lower cost
to the City and would merely be an expensive formality in which
the cost of the work would be substantially increased to the
City even though modified.
(3) All purposes of requiring advertising for bids, namely,
invitation of competiton, the guarding against favoritism,
improvidence, fraud and corruption in the award of municipal
contracts and securing the best work and supplies at the lowest
have been
price practicable,/attained and an award based on said bid as
revised would be for the benefit of property owners and tax-
payers of the City and will not benefit or enrich the Bidder
and will accomplish the construction of said reservoir with
sole reference to the public interest.
(4) The increase in capacity of said reservoir by 70,000
gallons at an additional cost of $1,000.00, in accordance with
said lowest responsible alternate bid, as revised by City
Engineer, is to the best interest of City and of its property
owners and taxpayers.

(5) The City Manager is authorized and directed to make and
enter into a written contract with said successful alternate
Bidder pursuant to the findings and determinations made in this
resolution, and the Clerk of said City is hereby directed to
attest his signature and to affix thereto the corporate seal
of said City.

of the City Council held on the 4th day of November, 1963,
and adopted thereafter by the following vote:
