AUTHORIZING ACQUISITIION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN
EASEMENTS REQUIRED FOR THE CONSTRUCTION OF A WATER STORAGE RESERVOIR,
WATER LINES, WATER MAINS AND APPURTENANCES
RESOLVED, that the public interest and necessity require the acquisition
by the City of Burlingame, a municipal corporation, of the casement particularly
described in Exhibit A which is attached hereto, incorporated herein, and made
a part of this resolution by reference.
The property particularly described in Exhibit A is required by the City
of Burlingame for a public use and purpose, to wit: for the construction of a
water storage tank, water distribution lines and water mains, and all appurtenances
necessary to a water storage and distribution system, and for the reconstruction,
maintenance, enlargement, operation, repair, renewal, replacement and removal of
said water storage tanks, and for the laying,relaying, construction, maintenance,
operation, repair, renewal, enlargement, replacement and removal of said water
distribution lines, and mains, all as a part of the municipal water system of the
City of Burlingame, for the use of said City and its inhabitants and for the
consumers served by said municipal water system, subject to such reservations and
conditions as may be necessary and proper to secure to the present owners of
said property all rights in, and the use and enjoyment of, said property, which
are not inconsistent with the rights to be acquired by the City of Burlingame in
the proceedings in eminent domain hereinafter authorized.
The City Attorney, and the law firm of WILSON, HARZFELV, PONES b MORTON,
as special legal counsel, are hereby authorized and directed to commence proceedings
in eminent domain against the owners of said real property and against all persons
having or claiming any right, title, or interest therein for the condemnation
thereof for the public use of the City of Burlingame, as aforesaid,
The City Attorney and special legal counsel are further authorized to
consent to the incorporation in any decree of condemnation which may be entered
in said proceedings such stipulations or conditions for the protection of the rights
of the present owners of said parcels to be condemned, or of any interest therein,
as the Court may find to be meet and proper,

Resolution was introduced at a regular meeting of the City Council held on the
16th day of September 1963, and adopted thereafter by the
following vote:

All of that real property situated in the County of San Mateo, State of
California, particularly described as follows:
PARCEL_It A right-of-way and easement to construct, reconstruct, maintain, enlarge,
operate, repair, renew, replace and remove water storage to nks, water distribution
lines, water mains and all appurtenances necessary to a water distribution and
storage systeiv, in, under and upon the following described lands situated in the
County of Seri Hatec, State of California, to -wit:
BEGINNING a;: a point S 40 degrees 1414611 E 880075 feet and S 49 degrees 45114"
W 230.00 feet from a 6" concrete monument with brass cap inscribed I'M. E. 24-134"
marking the intersection of the northeasterly line of State highway SIB-55-IV, also
known as Skyline Boulevard, with the southeasterly line of the Millbrae Villa
Tract as shown on that certain map entitled "Millbrae Villa Tract" recorded in
Volume B of Maps at Vage 36 and a certified copy Thereof recorded in Book 1 of
Maps at Page 37 in the office of the County Recorder, San Mateo County, California;
thence from said Point of Beginning S 49 degrees 45114" W 95,00 feet; thence at
right angles S 40 degrees 14,46" E 118.00 feet; thence at right angles S 49 degrees
45,141, W 5.00 feet; thence at right angles S 40 degrees 14,46" E 72.00 feet; thence
N 49 degrees 45,14" E 100.00 feet; thence at right angles N 40 degrees 14,46" W
190.00 feet; returning to the Point of Beginning and containing 0.42 acres of land.
PARCEL 20 A right-of-way and easement to lay, relay, construct, reconstruct,
maintain, operate, repair, renew, enlarge, replace, and remove water distribution
mains and lines, in, on, along and under the following described lands situated
in the County of San Mateo, State of California, to -wit:
BEGINNING at the most northerly corner of the above described 0,,42 acre parcel;
thence from said Point of Beginning N 49 degrees 45,14" E 150.00 feet to a point
on the southwesterly line of Skyline Boulevard above mentioned; thence along said
southwesterly line N 40 degrees 14146" W 20.00 feet; thence at right angles to said
southwesterly line of Skyline Boulevard S 49 degrees 45,141, W 245.00 feet; thence
at right angles S 40 degrees 1414611 E 20.00 feet; thence at right angles N
49 degrees 45114" E 95.00 feet to the Point of Beginning,
For the purposes of the description of PARCEL, I and PARCEL 20 the bearing of the
northeasterly line of Skyline Boulevard was taken as S 40 degrees 14'4611 E
