HomeMy WebLinkAboutReso - CC - 012-1963WHJM : KI'7 : j c 12/5/62 12c RESOLUTION NO. 12-63 A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF PROPERTY FOR OFF-STREET MOTOR VEHICLE PARKING PURPOSES AND AUTHORIZING EMINENT DOMAIN PROCEEDINGS PARKING DISTRICT NO. 1 RESOLVED, by the Council of the City of Burlingame, California, that WHEREAS, pursuant to Resolution of Intention No. 27-62, adopted by this Council on May 19, 1959, as modified, this Council did, on January 23 , 1963, adopt its Resolution No. 10-63 ordering acquisitions and improvements; WHEREAS, said Resolution of Intention and said proceedings were had and taken pursuant to the Municipal Improvement Act of 1913; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. The public interest and necessity require the acquisi- tion, construction and completion, by said City, of the public improvements described in said Resolution of Intention and in the proceedings relating thereto, as ,?odified, and the property pro- posed to be acquired described therein, and hereinafter described in E�chibit "A" hereto attached and incorporated herein by reference, is necessary therefor. 2. The taking of said property in fee is necessary. 3. The public necessity requires said acquisitions and improvements; said proposed acquisitions and improvements are planned and located in the manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are located within the territorial limits of the City of Burlingame. �y 4. Wilson, Harzfeld, Jones & Morton, San Mateo, California employed for that purpose, are hereby directed to institute and conduct to conclusion an action in eminent domain for the acquisition of said property, 1 and to take such action as is necessary therein. 5. Reference is hereby made.to said Resolution of In- tention and related proceedings for a particular description of the said proposed acquisitions and improvements, on file in the office of the City Clerk of said City. I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Burlingame, California, at a meeting thereof held on the 23rd day of January 1963, by the following vote: AYES, and in favor thereof, Councilmen: Crosby, Johnson, Lorenz, Martin, Morgan NOES, Councilmen: None ABSENT, Councilmen: None City Clerk of the City Of Burlingame APPROVED: Mayor 2. EXHIBIT "A" That portion of Lot 6, Block 3, Map No. 2 of the property of he Burlingame Land Co., 50 feet wide, lying contiguous to and mmediately southeasterly of the southeasterly line of a strip f land described as excepted from Parcel 3 of Parking Lot A n page 1 of 17, Exhibit A of the Engineer's Report on file in he office of the City Clerk.
