RESOLVED by the City Council of the City of Burlingame 1. An agreement be entered into between the City of Burlingame, a Municipal Corporation, and the County of San Mateo, a Political subdivision of the State of California, conforming in all respects to the copy of agreement entitled "AGREEMENT BETWEEN COUNTY AND CITY FIXING COMPENSATION TO COUNTY FOR ASSESSING AND COLLECTING TAXES FOR CITY", dated January 7. 19630 a copy of which is attached hereto, incorporated herein and made a part of this resolution. 2. White - City Clerk RESOLUTION NO. 1- (' BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN COUNTY AND CITY FIXING COMPENSATION TO COUNTY FOR ASSESSING AND COLLECTING TAXES FOR CITY RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that WHEREAS, it appears that Cjj:y 0 ,p gTIpj jTqq Am a city within the County of San Mateo, State of California, hereinafter called "City" has heretofore, by ordinance, transferred the assess- ment and tax collection duties performed by the City Assessor and and City Tax Collector of City to the County Assessor and County Tax Collector of the County of San Mateo pursuant to Section 51500 et seq of the Government Code; and WHEREAS, Section 51514 of the Government Code provides that the compensation to be paid by City to said County for assessing and collecting taxes on behalf of City shall be fixed by agreement between the Board of Supervisors of said County and City and a form of agreement fixing such compensation has been presented to this Board of Supervisors: NOW, THEREFORE, IT IS HEREBY ORDERED AND DETERMINED that the Chairman of this Board of Supervisors be, and he is hereby, author- ized and directed to execute said agreement with City for and on behalf of the County of San Mateo and the Clerk of this Board shall attest his signature thereto. BRUNING BY �'e_,s -,/ - 6 -:3, AGREEMENT BETWEEN COUNTY AND CITY FIXING COMPENSATION TO COUNTY FOR ASSESSING AND COLLECTING TAXES FOR CITY THIS AGREEMENT entered into this 5th day of February 196 by and between the COUNTY OF SAN MATEO, a political sub- division of the State of California, hereinafter called "County", and ITY URIJDNCAM�,' a city within the County of San OF BI Mateo, State of California, hereinafter called "City", W I T N E S S E T H: WHEREAS, City has heretofore, by ordinance, transferred the assessment and tax collection duties performed by the City Assessor and City Tax Collector of City to the County Assessor and County Tax Collector of County pursuant to Section 51500 et seq of the Government Code; and WHEREAS, Section 51514 of the Government Code requires that the compensation to be paid by City to County for assessing and collect- ing taxes on behalf of City be fixed by agreement between the Board of Supervisors of County and the city legislative body of City, not to exceed more than if for collecting the first $25,000.00 nor more than 1/4% for all sums over that amount; and WHEREAS, it is necessary and desirable that the parties hereto fix by agreement the compensation to be paid by City to County for assessing and collecting taxes on behalf of City as required by Section 51514 of the Government Code as hereinafter provided: NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO, as follows: 1. LENGTH OF AGREEMENT. This agreement shall be in full force and effect for a period of five (5) years, commencing on the 1st day of July, 1962, and ending on the 30th day of June, 1967, provided however that this agreement may be terminated by City prior to the expiration of this agreement by repealing said ordinance of City transferring the duties of the City Assessor and City Tax Collector of City to County, and by filing certified copies of said repeal- 1 . ing ordinance with the County Controller, the County Assessor and the County Tax Collector of County. Termination of this agreement in the manner herein provided shall terminate the same for all pur- poses except as to obligations accrued prior to the effective date thereof. 2. COMPENSATION BY CITY. It is agreed that the compensation to be paid by City to County for the assessing and collecting of taxes, sewer service charges and weed abatement assessments collect- ed in the same manner as such taxes, by County on behalf of City shall be, and is hereby fixed at the sum of Two Cents (2�) per par- cel of real property per fiscal year for each such parcel within City upon which such taxes or charges are assessed and collected by County on behalf of City during such fist -al year, provided, however, that the maximum compensation payable by City to County during any such fiscal year while this agreement is in effect shall not exceed a sum equal to 1% of first $25,000.00 and not more than 1/4% of all sums over that amount of taxes collected by County on behalf of City during such year. 3. MANNER OF PAYMENT OF COMPENSATION. For the purpose of deter- mining the amount of compensation payable by City to County pursuant to this agreement the County Tax Collector shall, on or before the 30th day of June of each fiscal year commencing with the fiscal year 1962-1963 determine the number of parcels of real property within City during such fiscal year, and shall submit a written statement to City showing the number of such parcels so determined and the amount payable by City to County pursuant to this agreement for such fiscal year. City agrees to pay the compensation payable by City to County pursuant to this agreement for each such fiscal year within sixty (60) days after receiving the written statement of the County Tax Collector for such fiscal year. 2. EMERSON 9-1441 December 6, 1962 Honorable Mayor and Members of the City Council City of Burlingame City Hall Burlingame, California Gentlemen: The enclosed is a copy of an agreement being forwarded to all Cities for whom the County is providing assessment and tax collecting services. As you may know, the Board of :Supervisors has recently adopted a policy of simplifying charges for this service. The agreement provides that compensation for such services will be based upon a charge of two cents per parcel. This represents a considerable reduction in costs from current charges of 1% of the first $25,000 plus 4 of 1% for the amount in excess and in most instances will represent a charge of less than $500 per year for contracting cities. You may be interested to know that the County plans to introduce legislation whereby even the nominal charge indicated may be dispensed with. In order that we may assure uniformity in the application of this policy, we are requesting all Cities contracting for these services to act upon the enclosed agreement. All six (6) copies should be signed and returned to this office for presentation to the Board of Supervisors for its formal action. Each City will receive a properly executed copy of this agreement.
