HomeMy WebLinkAboutReso - CC - 008-1963RESOLUTION NO. 8-63 A RESOLUTION ORDERING CHANGES AND MODIFICATIONS BURLINGAME AVE14UE AREA OFF-STREET PARKING DISTRICT RESOLVED, by the City Council of the City of Burlingame, California, that WHEREAS, pursuant to Resolution No. 71-62 of this Council ordering same, adopted on November 15, 1962, notice has been duly given of the intention of this Council to change and modify the proceedings under Resolution of Intention No. 27-62 adopted on May 19, 1962, as modified; and WHEREAS, persons interested appeared or filed written protests against said proceedings or any part thereof and all persons desir- ing to be heard were given an opportunity to be heard, and all tters and things pertaining to said changes and modifications ere fully heard and considered by this Council. NOW, THEREFORE,; IT IS ORDERED, that: 1. All protests and objections be, and they are hereby, loverruled. 2. The changes and modifications in the proceedings under I said Resolution of Intention be made and had, all as more particu- larly set forth as follows, to -wit: a) Change and modify the boundaries of the assessment Idistrict, the assessment and the assessment diagram to delete from Isaid district those certain lots or parcels of land, as follows, Ito -wit: All of Lot 1, Block 4, Burlingame Land Co., except that portion improved and used as a gasoline service station. b) Change and modify the acquisitions to be made, the work to be done and the plans and specifications therefor, as follows, to -wit: i. Eliminate all of tarcels 1-H and 2-H and substitute in place thereof all of Lots 5 and 6, Block 3, Burlingame Park. ii. Enlarge that portion of proposed Parking Lot E (1-E and 6-E) fronting on Lorton Avenue to include an additional parcel of land and the improvements thereon with approximately 80 feet of frontage on Lorton Avenue and a depth of 150 feet lying adjacent to and northwesterly of said existing proposed portion of Lot E. iii. Eliminate all of Lot 16, Block 10, Town of Burlingame and substitute in place thereof Lot 14, Block 10, Town of Burlingame. iv. Eliminate Lots 1-A, 2-A and 3-A fronting on Bellevue Avenue except that portion of Lot 3-A southeasterly of and behind Lot 4-A (50 feet wide, more or less) on through to Lots 5-A and 6-A. v. Eliminate all of Lot 6-F. c) Change and modify the proposed credits against assessments for existing parking facilities as contained in the application for credit filed by Ray Wurlitzer, as follows, to -wit: Allow credit for all landscape areas, walls, and walks, but not truck loading and access way area at southwesterly corner of the property. d) Increase Assessment No. 48 in accordance with the letter from Wilsey, Ham & Blair dated December 5, 1962, a copy of which is hereto attached and incorporated herein by reference. 3. The Engineer of Work is hereby directed to make said changes on the face of his report or file a supplement thereto reflecting said changes, and to recompute the estimate of cost and redistribute the assessment at the new rates resulting from said changes. COMPTON Reference: Parking District No. 1, Telephone Company Assessment Gentlemen: The property owner's petition, the City Council's Resolution of Intention, and the Engineer's Report prepared pursuant thereto all provide for an adjustment in the land assessed valuation of the property of the Pacific Telephone Company. This adjust;:ient was based on the premise that property evaluated by the State Board of Equalization was on the basis of 50'o of market value rather than 21.1;0, as is the case with locally assessed property. ivider_ce introduced at the hearing, particularly the assessments _levied against comparably sized and situated property, has let us to conclude that this premise was false and that public utility property is assessed by the State at something less than 505 of fair market value. In order to equalize the Telephone Company assessment with the others in the project on a fair and reasonable basis, we have co_raputed the area of the Telephone Company parcel and that of the adjacent three parcels to the East fronting on Burlingame Avenue and we find that the Telephone Company area is 28,E-10 square feet and that the neighboring parcels have 30,210 square feet. The original assessment against the latter was $33,124, or $1.0965 per square foot. Applying this original square foot rate to the Telephone Company lard area of 28,410, the original Telephone Company assessment would have been $31,152. This is the assessment which would have resulted from a land assessed valuation of $42,909.
