HomeMy WebLinkAboutReso - CC - 050-1962RESOLUTION NO. 50 - 62 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF BURLINGAME OF U1?INTHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ARMSBY PROPERTY", AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BURLINGAME: 1. That, pursuant to the provisions of the Annexation of J Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roil of the County of San Mateo, was filed with the Council of the City of Burlingame on August 20 , 19621 requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Burlingame and which said City and its Council propose to annex, is situate in the Town of Hillsborough, County of San Mateo, State of California, hereby designaed "Armsby Property", and particularly described in Exhibit A attached hereto, incorporated herein and made a part of this resolution by reference. 3. That the County Boundary Commission of San Mateo County, California, did in session duly assembled on Thursday, August 2, 1962, consider the proposed annexation boundaries of said "Armsby Property", as above described, and as submitted to said Commission by the proponents of said annexation. 4. That Monday, October 1, 1962, at the hour of 8:00 p.m., in the Council Chambers in the City Hall in the City of Burlingame, County of San Mateo, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Burlingame, and having any objections to the proposed annexation, may appear before the Council of the City of Burlingame and show cause why such uninhabited territory should not be so annexed to the City of Burlingame. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Burlingame is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Advance -Star, a newspaper of general circulation published in said City of Burlingame, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexa- tion to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 7. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. A I, Herbert K. White, City Clerk, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 20th day of August 1962, and adopted thereafte by the following vote: Ayes: Councilmen: Johnson, Lorenz, Martin Noes: Councilmen: None Absent Councilmen: Crosby, Morgan ExHIBIT A BEGINNING at the most southerly corner of lot 6 in Beverly Terrace, an unrecorded subdivision, City of Burlingame where said corner ,meets the westerly right-of-way line of RJosevelL Avenue; thence X 55010'18" W 108.76 feet to the most westerly corner of said l t 6; Lneace N 55010,18" W 16.22 feet to a point on the present City limit line of the City of Burlingame as said line is described in Section 201, Article 25 Boundary, Burlingame ordinance Code dated December 1941, which point is also described in the Special Election if the TOM 0f Hillsborough of April 10, 1916, which point is the most easterly corner of lot 2 of Reynolds Woods as said lot is shown on that certain ;map entitled Reynolds 'floods, Hillsborough, California, which map was filed for record at page 8, book 56 of Naps, records of San Mateo County, California on the 27th day of March 1962; thence S 45035'09" W 61.07 feet along the comma" boundary line 0f the City of Burlingame and the Town of Hillsbor0ugn to the TRUE POINT OF BEGINNING; thence from said TRUE PINT OF BEGINNING along the southwesterly prolongation of said common boundary S 45035'09" W 52.37 feet; thence S 27000' E 201.13 feet; thence S 42910' E 55.78 feet; thence 59030' E 174.92 feet to a point on the common boundary line of the City of Burlingame and the Town of Hillsborough; thence N 55010'18" W 294.90 feet along said existing city boundary line to the TRUE POINT OF BEGINNING.
