RESOLUTION NO. 36 - 62
A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND
NECESSITY REQUIRE THE ACQUISITION AND TAKING OF CERTAIN
LAND AND DIRECTING THE FILING OF EMINENT DOMAIN
PROCEEDINGS
RESOLVED, by the City Council of the City of Burlingame,
California, that;
WHEREAS, it is the intention of this City to acquire the
land more particularly described in Exhibit "A", attached hereto
and by this reference made a part hereof, for the purpose of the
disposal of storm waters, and City refuse, and for public park
and recreational purposes;
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, aS
follows:
1. That the public interest and necessity re�,zire the ac-
quisition, construction and completion by said city of areas for
the disposal of storm waters and City refuse, and for public park
and recreational purposes in and on the land more particularly
described in said Exhibit "A", and that the taking of the fee
simple title in and to said land is necessary therefor.
2. That the proposed improvement is planned and located in
the manner which will be most compatible with the greatest public
good and the least private injury.
3. That Burress Karmel, City Attorney of the �"Ity of Bur-
lingame, and the law firm of Messrs. Wilson, Harzfeld, Jones &
Morton, San Mateo, California, employed for that purpose be, and
they are, hereby directed to institute and conduct to conclusion
an action in eminent domain for the acquisition of said land and
the taking of such action as is necessary therein.
I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the
City Council of the City of Burlingame, California, at a meeting
thereof held on the 2nd day of July , 1962, by the
following vote:

Crosby, Johnson, Martin, Morgan
NOES, Councilmen: None
ABSENT, Councilmen: Lorenz

EXHIBIT "A"
All that real property situated in the City of
Burlingame, County of San Mateo, State of California,
particularly described as follows:
BEGINNING at the northeasterly corner of the
parcel of land described in the deed from Burlingame Shore
Land Company, a Corporation, to the City of Burlingame, a
Municipal Corporation„ dated April 26, 1951, and recorded
May 31, 1951, in Book 2078 of Official Records at page 523
(File 39555-J) Records of San Mateo County, California;
THENCE southeasterly along the northeasterly
line of swamp and overflowed lands Survey No. 12, S.
490 11' 15" East 781,08 ft., S. 626 541 15" E. 363�53 ft.
to a point on the northerly boundary of the Bayshore Freeway
Boundary established in Deed from said Burlingame Shore Land
Company to the State of California, dated June 30, 1943 and
recorded August 31, 1943 in Book 1076 of Official Records
at page 343 (File No. 91307-E) Records of San Mateo County.
THENCE leaving said swamp and overflowed lands
survey line and continuing northwesterly and northerlyy
along the boundaries of the Bayshore Freeway N. 880 04` W.
396.00 ft, thence N 700 49" W. 198,00 ft; thence
S, 810 11' W. IW 85°v
THENCE N. 720 19' W, 166,40 ft., thence on a
curve to the right the center of which bears N. 290 23' 08" E
having a radius of 3647.001 and an internal angle of
10 08 19" an are distance of 72.47 ft.,p
THENCE leaving said boundary of Bayshore Freeway
N 150 34" 48" E. 293.:90 ft'. thence N. 490 11' 15" W. 140.32 ft.
to the southeasterly corner of the parcel described in above
deed from Burlingame Shore Land Company to the City or Burl=
ingamej thence northeasterly along the southeasterly Line of
last mentioned parcel N,. 330 451 East 200.00 ft., to the point
of beginning, and containing 6.23 acres of land more or less.
