HomeMy WebLinkAboutReso - CC - 029-1962RESOLUTION NO. 29-52 :ADOPTING RULES FOR THE APPOINTMENT OF MEMBERS OF CITY BOARD A11D CO_M4IISSIONS RESOLVED, by the City Council of t-:-:e City.- Of Bl=lirgame, l.ifornia: NEW BO.zMS AND COM1VISSIONS The following rules stall govern the appointment of embers to any board or commission w'nich may hereafter be stablished by the City Council: 1. Each member of the City Cor.ncil shall propose tl�e ames of two prospective members of sucl, boards or commissions y submitting such names it wri.ting to the City Manager on or afore a date to be fixed by the City Council. 2. Immediately after the date fixed by the Citv Council -ie City Manager shall mail a letter to each person named, wising him that his name has been proposed for mem71-ers7-4- o ie board or commission by a member of the City Council aind questing advice in writing within 10 da_,s whetoer he will accent ,e appointment it if is made. 3. Eleven days after mailing said letters, tie C. Lnager shall advise the City Council il-I writing 0= t'.e co.sAr.t serve or refusal thereof or failure to reply, as the case m�-- of each person to whom Lis letter was addressed. 4. Upon receipt of said letter from tl.e City Manager �e Mayor shall call a spec .al. meet-i—T of tl,e Citv Council in \ ,e manner required for call special meetings by GOveY'17me't Code 4S55, for the purpose of interviewing the persons whose written ,%, consents to serve have been received and for the further purpose of making appointments to such board or commission, and the r shall direct the City Manager to notify each such person of the time and place of such special meeting and to attend for the purpose of being interviewed by the City Council. 5. At the special meeting the persons whose written sents to serve have been received shall be interviewed separately by the City Council Sitting in executive session and when all of said persons have been interviewed, the City Council shall appoint the members of such board or commission by majority vote. APPOINTMENTS TO VACANCIES The following rules shall govern the appointment of persons to fill vacancies which may hereafter arise in the member- ship of any hoard or commission: 1. Each member of the City Council shall propose the name of one prospective member of such board or commission for =_ach vacancy thereon by submitting such name in writing to the �ity Manager on or before a date to be fixed by the City Council. 2. Prospective members shall be notified and shall state their willingness to serve, if appointed; the City Council ;hall be notified of their willingness or refusal to serve or failure to state such willingness or refusal; and a special neeting of the City Council for the purposes of interview and appointment shall be called, all at the times and places and in the manner provided in this resolution for the appointment of nembers to boards or commissions which may be established here- after. 3. When the interaviews have been concluded, the City ;ouncil shall select the person or persons to fill the vacancy )r vacancies by majority vote. EXPIRED TERMS The following rules shall govern the appointment of )ersons to succeed members of boards or commissions whose terms have expired: 1. The City Clerk shall notify the City Council in (writing of the expiration of the term of any board member or commissioner at the next regular meeting of the City Council following such expiration. 2. At the next regular meeting of the City Council following such expiration, or at the following regular meeting of the City Council, any councilman may propose the name of one person to be appointed to the office of the board member or commissioner whose term has expired by submitting such name in writing to the City Manager. 3. If three or more councilmen propose names, the name of the board member or commissioner whose term has expired shall be added to the list and all persons whose names appear on the list shall be notified and shall state their willingness to serve, if appointed, the City Council shall be notified of their will- ingness or refusal to serve or failure to state such willingness or refusal, and a special meeting of the City Council for the purpose of interview and appointment shall be called, all at the times and places and in the manner provided in this resolution for the appointment of members to boards or commissions which may be established hereafter. 4. When the interviews have been concluded, the City Council shall select the person to be appointed to the office of the board member or commissioner whose term has expired by majority vote. 5. If three or more councilmen do not propose the name of a person to be appointed to the office of the board member or commissioner whose term has expired, then the Mayor shall appoint the incumbent board member or commissioner to succeed himself and shall immediately call for a vote approving the appointment. The appointment shall be approved by a majority vote of the City Council. 1 PRESUMPTION Whenever any law, statute, ordinance, resolution, regulation or rule provides for the appointment or nomination of any person to membership on a board or commission, or to fill a vacancy thereon, or to succeed to the office of a board member or commissioner whose term has expired, by the Mayor with the approval, or with the consent, or subject to the confirmation of the City Council, appointments or nominations made and consents or confirmations given in accordance wit?-: the provisions of this resolution shall be deemed to have been made in conformity with the requirements of such law, statute, ordinance, resolution, regulation or rule.
