HomeMy WebLinkAboutReso - CC - 004-1962RESOLUTION NO. 4-62 A RESOLUTION DECLARING THAT A I�,AJORITY PROTEST HAS NOT BEEN MADE - ENGSTRON AND OTT PROPERTIES ANNEXATION RESOLVED, by the City Council of the City of Burlingame, California, that WHEREAS, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by all of the owners of the privately owned territory- described in Exhibit A, attached hereto, incorporated herein, and made a part of this resolution by reference, was filed with the Council of the City of Burlingame on November 20 , 1961, requesting annexation of said territory to said City; and WHEREAS, the County Boundary Commission of San Mateo County, California, did in session duly assembled on November 2, 1961 1961, approve the proposed annexation of "ENGSTROM AND OTT I PROPERTIES" as described in said Exhbit A and as submitted to said Commission by the petitioners for said annexation; and ,4HEREAS, on December 4, 1961, the Council of the City of Burlingame did pass and adopt Resolution No. 62-61 giving notice of the proposal to annex certain uninhabited territory to -the City of Burlingame, said territory being therein designated as "Engstrom and Ott Properties", said resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 62-61 did contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within 'the territory proposed to be annexed, the time of said hearing being not less than 40 days nor more than 60 days from the date of passage of said resolution; and WHEREAS, on the 15th day of January, 1962, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall in the City of Burlingame, County of San Mateo, State of California, said time and place being the day, hour and place fixed in said Resolution No. 62-61 for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation and did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed as shown by the last equalized assessment roll as determined by said legislative body: NOW, THEREFORE, said Council does hereby FIND, DETERMINE AND ORDER, as follows: That the owners of one-half of the value of the privately owned territory proposed to be annexed did not, at or prior to the time fixed for said hearing file written protests against the said proposed annexation and that none of the territory proposed to be annexed is publicly owned.
