RESOLUTION APPROVING CATEGORICAL EXEMPTION AND
PARKING VARIANCE AMENDMENT
RESOLUTION NO. 17-2001
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a parkin
variance amendment to extend the days of operation for an existing retail and food establishment at 1205
Howard Avenue, zoned C-1, Subarea B, Roberta Oswald,property owner, APN: 029-224-050;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 12, 2001, at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19. Categorically Exempt per Section: 15301 - Existing facilities, Class 1(a), interior or
exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances, is
hereby approved.
2. Said parking variance amendment is approved, subject to the conditions set forth in Exhibit
"A" attached hereto. Findings for such parking variance amendment are as set forth in the minutes and
recording of said meeting.
3. Itis further directed that a certified copy of this resolution b recorded in the official records
of the County of San Mateo.

Commission held on the 12th day of February, 2001 ,by the following vote:

EXHIBIT "A"
Conditions of approval for categorical exemption and parking variance amendment.

effective February 20, 2001
1. that the food establishment on this premise shall conform to the plans submitted to the
Planning Department and date stamped January 24, 1991, that the food establishment shall
not exceed 475 SF including kitchen and seating area although the 320 SF seating area with
eight tables may move within the retail area, the second floor shall only be used for storage
related to the business on the first floor, and there shall be no office use on the second floor;
2. that there shall be no more than two employees on site working in the food establishment
portion of the business;
3. that the food establishment portion of the business may not be open for business except
during the hours of 11:30 a.m. to 4:30 p.m., seven days a week;
4. that the use and any improvements for the use shall meet all California Building and Fire
Codes, 1998 Edition as amended by the City of Burlingame;
5. that any expansion of the seating area, kitchen, food preparation area and service area,
change in the number of employees in the food establishment or upgrading of the kitchen
area shall require an amendment to this permit; and
6. that this permit shall be reviewed for compliance with its conditions in one year(February,
2002) and upon complaint thereafter.
