RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND CONDITIONAL USE PERMITS FOR AN ACCESSORY STRUCTURE
RESOLUTION 45-2001—
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
conditional use permits for an accessory structure for construction of a new garage with home office and
artist's studio with windows within 10' of property line at 1433 Sanchez Avenue, zoned R-2, Jennifer
Hayden and William Ryan property owners, APN: 026-223-130;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
May 29, 2001 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
Article 19, Section15303, New Construction or Conversion of Small Structures Class 3 (e), Accessory
(appurtenant)structures including garages,carports,patios, swimming pools and fences is hereby approved.
2. Said conditional use permits for an accessory structure is approved, subject to the conditions
set forth in Exhibit "A" attached hereto. Findings for such conditional use permits for an accessory
structure are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval categorical exemption and conditional use permits for an accessory structure
1433 Sanchez Avenue
effective June 4, 2001
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped May 18, 2001, Sheet(s) 1 and 2, Site Plan, Floor Plan, Section and
Elevations;
2. that the conditions of the Chief Building Official's March 26, 2001 memo, the City
Engineer's March 26, 2001 memo, and the Recycling Specialist's March 26, 2001 memo
shall be met;
3. that the accessory structure shall be used as a garage, a home office and an artist's studio,
with sink and no toilet, and shall never be used for accessory living or sleeping purposes;
shall never include a kitchen, and shall not include additional utility services and/or a toilet
without an amendment to this conditional use permit; and
4. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 1998 Edition, as amended by the City of Burlingame.
