Date: 08.24.01 Margar t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION, CONDITIONAL USE APPLICATION AND PARKING VARIANCE RESOLUTION 77-2001 RESOLVED,by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit and parking variance for real estate(1115)and office/warehouse use (1117) at 1115 and 1117 California Drive, zoned C-2, Christine Crema&Brian Fearon,property owners, APN: 026-191- 290; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on August 13, 2001, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption,per CEQA Article 19. Categorically Exempt per Section: 15303—Class I-the operation repair,maintenance, or minor alteration of existing public or private structures, facilities,mechanical equipment,or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alternations involving such things as interior partitions,plumbing, and electrical conveyances. 2. Said categorical exemption, conditional use permit and variance are approved, subject to the conditions set forth in Exhibit"A" attached hereto. Findings for such conditional use permit and variance are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. i 111111 1111 Illilllllllllllllllllililllilllilllliliillli 2@02212 04P CHAIRMAN I, Martin Dreiling, Acting Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 13th day of August, 2001 ,by the followin vote: Auran,Keig ran,Luzuriaga, OsFerling and Vistica AYES: COMMISSIONERS: NONE NOES: COMMISSIONERS: Bojues and Dreiling ABSENT: COMMISSIONERS: ACTING SECRFXARY 11111111111IIIIIIIIIIIIIIIfIIIlll1illl1IllliIIIIIIIIII 20023 of 3 EXHIBIT "A" Conditions of approval for categorical exemption, conditional use permit and parking variance. 1115 and 1117 CALIFORNIA DRIVE effective AUGUST 20,2001 1. that the real estate office use shall be limited to 1,742 SF at 1115 California Drive (the front tenant space), as shown on the plans submitted to the Planning Department and date stamped August 1, 2001, site plan and floor plan; 2. that the real estate office shall have regular business hours from 9:00 a.m. to 5:00 p.m. Monday through Friday, with weeknight use not to exceed two times per week and weekend use to be limited to two times per month for a limited number of agents; 3. that there shall be no more than two monthly meetings for all agents on this site and they shall be scheduled at a time when business for the adjoining tenant business is least, and that if there are any complaints by the adjacent tenants regarding the parking impacts from this meeting this use permit shall be reviewed by the Planning Commission; 4. that the maximum number of employees on site (including both tenant spaces 1115 and 1117) shall be limited to 20, 18 for the real estate office and 2 for the remaining tenant space; 5. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; 6. that any change in use from the approved uses on site, a real estate office at 1115 California :Drive and a combined graffic design office (400 SF office - 1850 SF warehouse) and wholesale distributing business at 1117 California Drive, shall require Planning Commission review of the conditional use permit and parking variance on site; and 7. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame.
