Date: 02.01.99 argair t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SIDE SETBACK AND LOT COVERAGE VARIANCES RESO-7-99 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a Categorical Exemption has been proposed and application has been made for a setback and lot coverage variances for first floor addition at 9 Bayswater Avenue, zoned R-1, Glenn and Alma Grossman nroWily owners, APN: 029-305-030; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on Janu= 11, 1999 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per CEQA Article 19, Section 15303, construction and location of limited numbers of new, small facilities or structures including (a) single-family residences not in conjunction with the building of two or more such units is hereby approved. 2. Said side setback and lot coverage variances is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such side setback and lot coverage variances are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Dave Luzuriaaa , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 11th day of Janes, 1999 , by the following vote: AYES: COMMISSIONERS: BOJUES, COFFEY, LUZURIAGA, VISTICA AND DEAL NOES: COMMISSIONERS: KEIGHRAN AND KEY ABSENT: COMMISSIONERS: NONE v LSEC RY � G, EXHIBIT "A" Conditions of approval Categorical Exemption and side setback and lot coverage variances 9 Bayswater Avenue effective January 20, 1999 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped December 24, 1998, sheets A.1 through A.4, sheet E.1 and sheets S.1 and 5.2; 2. that the second dwelling unit in the garage on this property be removed before a building permit is issued for this project; 3. that a distance of at least 4 feet shall be maintained eave to eave between the structures on this site and that the baywindow shown as a part of the project shall be designed to extend to a foundation in the ground; 4. that the conditions of the Chief Building Official's and Fire Marshal's November 30, 1998 memos, and the City Engineer's November 16, 1998 memo shall be met; and _. 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame. 2 ROUTING FORM DATE: November 30, 1998 TO: CITY ENGINEER CHIEF BUILDING OFFICIAL _FIRE MARSHAL SR.
