RESOLUTION APPROVING CATEGORICAL EXEMPTION AND AMENDMENT TO
CONDITIONAL USE PERMIT

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for gn
amendment to conditional use permit to expand an existing office building where office exceeds 50% of the
gross floor area of the building at 1400 Rollins Road, zoned M-1. APN: 026-102-140; Cal-Tex Properties.

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame onlanuary
251999, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
Article 19. Section: 15301 (e) - Additions to existing structures provided that the addition will not result in
an increase of more than: (1) 50 percent of the floor area of the structures before the addition, or 2,500 square
feet, whichever is less is hereby approved.
2. Said amendment to conditional use permit is approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such amendment to conditional use permit is as set forth in the
minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval for categorical exemption and amendment to conditional use permit.

effective February 1, 1999
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped November 18, 1998 (sheets 1 and 2) and December 18, 1998 (sheet 3) and
that any change in use or footprint shall require and amendment to this permit;
2. that the conditions of the City Engineer's November 24, 1998 memo, the Chief Building
Official's November 23, 1998 memo and Fire Marshal's November 19, 1998 memo shall
be met;
3. that the employee picnic area shall be removed and the paving and/or ground surface repaired
as a part of the proposed tenant improvement;
4. that no temporary structures shall be placed on this site without property City permits; and
5. that the use and any improvements for the use shall meet all California Building and Fire Codes,
1995 Edition, as amended by the City of Burlingame.
