Date: 02.18.99 1 -w1alLuourn G� Margar t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION, CONDITIONAL USE PERMITS AND SPECIAL PERMITS FOR AN ACCESSORY STRUCTURE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for conditional use permits and special permits for an accessory structure for construction of a new garage at 1516 Forest View Avenue, zoned R- 1 , Chris and Jan Keele, APN: 028- 131-080; WHEREAS , said matters were heard by the Planning Commission of the City of Burlingame on February 8, 1999 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1 . On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15303 , new construction or conversion of small structures Class 3 (e) , accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. 2. Said conditional use permits and special permits for an accessory structure are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permits and special permits for an accessory structure are as set forth in the minutes and recording of said meeting. 3 . It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. HAIRMAN I, Dave Luzuriaga , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 8th day of February , 1999 , by the following vote: AYES : COMMISSIONERS : NOES : COMMISSIONERS : ABSENT: COMMISSIONERS : ABSTAIN: COMMISSIONER: DEAL SECRE RY EXHIBIT "A" Conditions of approval categorical exemption, conditional use permits and special permits for an accessory structure 1516 FOREST VIEW AVENUE EFFECTIVE FEBRUARY 17, 1999 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped January 28, 1999, Sheet G-1, Site Plan, Floor Plan and Elevations; 2. that the conditions of the Chief Building Official's November 23, 1998 memo shall be met; 3. that the accessory structure shall never be used for accessory living or sleeping purposes; shall never include a kitchen, and shall not include additional water and sewer connections and/or a toilet without an amendment to this conditional use permit; 4. that the roof drainage from the accessory structure shall drain to the front street; 5. that the location and size of the garage shall not be used as a hardship when considering ;fix future additions to the house; and us-2 6. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 1995 Edition, as amended by the City of Burlingame. === AF: 2 ROUTING FORM DATE: November 23, 1998 TO: _CITY ENGINEER CHIEF BUILDING OFFICIAL _FIRE MARSHAL _SR.
