Date: 02.23.99 RESOLUTION APPROVING CATEGORICAL EXEMPTION, PARKING VARIANCE RESO-17-99 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a parking variance for conversion of an auto-mechanic shop to retail space at 1212 Donnelly, zoned R-2, APN: 029-151-140; Day Trust, owners: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on February 8, 1999, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the Basis of the documents submitted and reviewed and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption Article 19, Section 15301 - existing facilities, Class 1 (e2), additions to existing structures and conversion of use, provided that the addition will not result in an increase of more than 10,000 SF if the project is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan and the area in which the project is located is not environmentally sensitive, is hereby approved. 2. Said parking variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variance are set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded i the official records of the County of San Mateo. JE HAIRMAN I, David LuzudW, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 8th day of February, 1999, by the following vote: AYES: COMMISSIONERS COFFEY, KEIGHRAY, LUZURIAGA AND VISTICA NOES: COMMISSIONERS DOJ ES, KEY AND DEAL i ABSENT: COMMISSIONERS NONE DAVID L Z AG SEC ARY EXHIBIT "A" Conditions of approval of categorical exemption, parking variance. 1212 DONNELLY AVENUE EFFECTIVE FEBRUARY 17, 1999 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped February 2, 1999, Sheets A-1 and A-2; 2. that the conditions of the City Engineer (memo dated November 16, 1998), and the conditions of the Fire Marshal and Chief Building Inspector (memos dated November 30, 1998) shall be met; 3. that the applicant shall apply for and receive approval_ of a sign permit prior to erecting any signage at project site; 4. that the retail tenants shall not use the rear patio area for storage of retail materials, fixtures or any other item, except for placement of trash and recycling cans and bins placed and managed in accordance with the Burlingame Fire Department requirements; 5. that, if applicant chooses, the entrance can be recessed with same square footage. and, 6. that the variance is granted for the use of the existing building to be expanded as shown on the plans date stamped February 2, 1999 and if this building is demolished, the variance shall become null and void; 7. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 as amended by the City of Burlingame.
