RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND PARKING VARIANCE AND CONDITIONAL USE PERMITS
RESO=18-99
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
ping variance and conditional use permits for a restaurant and cocktail lounge in an existing boat in
Sanchez Channel at 410 A rnort Boulevard, zoned C-4, State of California, State Lands Commission.

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
Februw8, 1999 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15301, existing facilities, Class 1(a), interior or exterior alterations involving
such things as interior partitions, plumbing, and electrical conveyances is hereby approved.
2. Said parking variance and conditional use permits are approved, subject to the conditions
set forth in Exhibit "A" attached hereto. Findings for such parking variance and conditional use permits
are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval categorical exemption, parking variance and conditional use permits
410 AIRPORT BOULEVARD
EFFECTIVE FEBRUARY 17, 1999
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 14,1998, Sheets 1 through 7, and date stamped January 8, 1999,
Sheet 8;
2. that the conditions of the Chief Building Official's January 8, 1999 memo, the Fire
Marshal's August 18, 1998 and January 7, 1999 memos and the City Engineer's August
17, 1998 memo shall be met;
3. that the restaurant and cocktail lounge may not be open for business except during the
hours of 11:00 A.M. to Midnight, seven days a week, with no more than fourteen
employees on site at any one time;

4. that the applicant shall obtain a permit from the Bay Conservation and Development 0
Commission (BCDC), and shall provide an 8-foot wide public access walkway suitable for
disabled access from the sidewalk on Airport Boulevard to the leasehold boundary;

5. that the final design of the observation platform shall be subject to review and approval `1

by BCDC;
6. that the offices located in the top deck shall only be used in conjunction with the restaurant
and cocktail lounge and shall not be rented or leased for a separate office use;
7. that the parking issue shall be reviewed by city staff in 18 months to determine adequacy
of parking, and if State Lands provides additional 4 spaces, the variance can be dissolved;
8. that the applicant submit a lighting plan to be reviewed by city staff prior to issuance of
any building permits for remodeling work on the boat or site; and
9. that any improvements for the use shall meet all California Building and Fire Codes, 1995
Edition as amended by the City of Burlingame.
