RESOLUTION APPROVING CATEGORICAL EXEMPTION,
LANDSCAPE VARIANCE AND AMENDMENT TO USE PERMIT
RESOLUTION-53-99
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for --a
landscape variance and conditional use permit for a rental car operation at 820 Malcolm Avenue
zoned O-M , APN: 026-301-190 ; Monfredini Properties, owner.
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
April 261999 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption per
Section 15301, Class 1(a), Existing Facilities, Interior or exterior alterations involving such things as
interior partitions, plumbing, and electrical conveyances, is hereby approved.
2. Said special permit, subject to the conditions set forth in Exhibit "A" attached hereto.
Findings for such special permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

Conditions of approval categorical exemption, landscape variance and use permit

effective MAY 3, 1999
1. that the project shall be built as shown on the application material and plan submitted
to the Planning Department and date stamped April 16, 1999, Sheets A-1 and L-1,
N with 7640 SF of office space, none of which shall be subleased to any other business,

0m m 2. that the office and car rental may not be open for business except during the hours of
01_a 9 AM - 5PM seven days per week (Sunday through Saturday) when a maximum
number of 25 employees are allowed on site, and after 5PM, Sunday through
Saturday, when one employee is allowed on site;
3. that there shall be provided 26 parking spaces for the office workers (24 standard, 2
handicap); 43 parking spaces to accommodate 25% of the average monthly car rentals
from this site (160), consisting of: 5 standard stalls; 28 standard tandem stalls; and
10 compact tandem stalls: and that the gate be relocated to the area behind stall #10
or further back, exceeding the limit of an average of 160 rentals per month shall
cause this use permit to be reviewed;
4. that this site shall not be used for long term storage of car rental fleet cars regularly
leased at another location;
5. that all washing and detailing of fleet cars from this location shall be conducted at the
SFO car rental facility; that all auto repairs (major and minor) shall be conducted at
the respective dealers from each of the fleet cars is purchased; and that all oil changes
shall be conducted off-site at a professional oil-changing location;
6. that there shall be no use of vehicle carriers to pick-up or deliver rental cars from this
location;
7. that the applicant shall establish landscaping and irrigation according to the site plan
submitted to this office on April 16, 1999, which documents 80% of the landscaping
provided shall be within the front half of the site; all landscaping shall be irrigated
and the landscaping shall be maintained on this site pursuant to the plan submitted to
the Planning Department on April 16, 1999; and
8. that any improvements for the use shall meet all California Building and Fire Codes,
1995 Edition as amended by the City of Burlingame.
