Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT RESOLUTION-72-99 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for conditional use permit for a financial institution at 1155 California Drive, Suite D. zoned C-2. APN: 026-191-300;Mansa Construction Corporation, property owner; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on June 28, 1999, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per Article 19. Section:15301 - Existing Facilities, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit is as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution e recorded in the official records of the County of San Mateo. CH I, Stanley Vistica, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 28th day of June, 1999 , by the following vote: AYES: COMMISSIONERS: BOJUES, DEAL, KEIGHRAN, VISTICA, DREILING AND LUZURIAGA NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: COFFEY SE ITARY EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 1155 CALIFORNIA DRIVE, SUITE D effective July 6, 1999 1. that the financial institution shall be limited to 895 SF in Suite D, at 1155 California Drive, as shown on the plans submitted to the Planning Department and date stamped June 3, 1999, sheets A-1 and A-2; 2. that the financial institution may not be open for business except during the hours of 9:00 a.m. to 5:00 p.m., Monday through Friday and 10:00 a.m. to 2:00 p.m. on Saturday, with N a maximum of 3 employees on site at any one time; m m 3. that any changes in operation, floor area, use, or number of employees, which exceeds the Ba maximums as stated in these conditions shall require an amendment to this use permit; N m M4. that all deliveries to the site including pick up and delivery of cash shall be scheduled once mm -- mn a week; moa 5. employees shall not park in the on-site parking spaces, and shall be required by their employer to park off-site; 6. that the use in Suites G and H at 1155 California Drive, Burlingame, California, as shown on the plans date stamped June 3, 1999, sheets A-1 and A-2, on file with the Planning Department of the City of Burlingame, and consisting of 2,888 SF shall be limited to only furniture stores, appliance stores, or bulk merchandise (no more than 48 SF of which may be used for office space). The property owner shall be solely responsible for notifying all prospective tenants or purchasers of Suites G and H of this restriction and for enforcing _ this restriction. The property owner shall also notify the City Planner at 501 Primrose Road, Burlingame, CA 94010, in writing at least thirty (30) days in advance of any change in the tenant of either Suite G or H. The property owner agrees that violation of this condition shall be grounds for revocation of the conditional use permits for the entire property at 1155 California Drive, Burlingame, CA; and 7. that the use and any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame.
