Date: 08.03.99 - CwarA_ ez__� Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND LOT COVERAGE VARIANCE RESOLUTION-74.99 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a Categorical Exemption has been proposed and application has been made for a.a lot coverage variance for the replacement and enlargement of a rear yard deck at 1314 DeSoto Avenue, zoned R-1, Brian and Lauri Shanahan, property owner, APN: 027-151-260; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 12, 1999, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per CEQA Section 15303 is hereby approved. 2. Said lot coverage variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variance are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this r lution be recorded in the official records of the County of San Mateo. ICHAEL C4FEY'CHAfRMAN Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 12 th day of-Lly-, 1999 , by the following vote: AYES: COMMISSIONERS: BOJUES, DEAL, DREILING, KE7 GHRAN, LUZURIAGA AND COFFEY NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: VUSTUCA ABSTAIN: COMMISSIONERS: NONE -- Ca4- RETARY 'f 4 EXHIBIT "A" Conditions of approval Categorical Exemption and Lot Coverage Variance 1314 DeSoto Avenue effective August 2, 1999 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped June 18, 1999, Sheet 1 of 2; 2. that the granting of 4% lot coverage for deck purposes on this hillside lot shall not entitle the property owner to expand the habitable space or dwelling footprint on this site to more than 40% of the lot without the granting of an additional variance, even if deck area is removed for the addition; and 3. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame.
