RESOLUTION APPROVING CATEGORICAL EXEMPTION,
LANDSCAPING VARIANCE, CONDITIONAL USE PERMITS
AND CONDITIONAL USE PERMIT AMENDMENT
RESOLUTION-94-99
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a -a
landscaping variance, conditional use permits to vary from the landscape design guidelines for bayfront
development and conditional use permit amendment for expansion of office facilities at an existing office,
stogy~ge and maintenance facility for a car rental business at 1650 Bayshore Highway, zoned C-4, Bayshore
Holdings, LLC, 3 Corporate Park #220, Irvine, CA, 92606, property owner, APN: 026-282-130;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
August 9, 1999 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15303, new construction or conversion of small structures, Class 3 (c), a
commercial structure not involving the use of significant amounts of hazardous substances and not exceeding
2500 SF in floor area is hereby approved.
2. Said a landscaping variance, conditional use permits and conditional use permit amendment are
approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such a landscaping
variance, conditional use permits conditional use permit amendment are as set forth in the minutes and
recording of said meeting.
3. It is further directed that a certified copy of this resolution b recorded in the official records
of the County of San Mateo.

Conditions of approval categorical exemption, landscaping variance, conditional use permits to vary from the
landscape design guidelines and conditional use permit amendment
1650 Bayshore Highway
effective August 16, 1999
1. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped July 14, 1999, Sheets A1.0 and A3.1, and date stamped July 30, 1999, Sheet Al.la;
2. that the landscaping variance, amendment to the 1966 conditional use permit and conditional use permits
to vary from the Design Guidelines shall be limited to the current use of the site as an office, storage
and maintenance facility for a car rental business which includes used car sales, when any one or all of
these uses are discontinued on this site, the variance and conditional use permits shall be automatically
revoked, or if the office use on this site should be further expanded to be the only use on the site, then
any variances and conditional use permits shall be automatically revoked;
3. that there shall be a minimum of 69 designated employee parking spaces in the parking structure and
7 designated customer parking spaces on the east side of the office building for a total of 76
customer/employee parking spaces on site, all employee parking spaces shall be a minimum of 8' wide
and 20' long and shall be designated as employee parking spaces by having the designation painted on
the asphalt of the space; the employee parking stalls shall be designated, labeled and inspected as being
adequate by the Planning Department before the developer calls for the final building inspection; each
employee's car shall be identified by an employee parking sticker;
4. that 27 1-gallon creeping fig vines shall be planted along the front face of the parking structure and
irrigation shall be provided to these vines as shown on Sheet A1.la date stamped July 30, 1999, all
plantings and irrigation shall be installed prior to calling for final building inspection;
5. that the office, storage and maintenance facility for a car rental business which includes used car sales
may not be open for business except during the hours of 8:00 A.M. to 6:00 P.M. seven days a week,
with no more than 66 employees on site at any one time;
6. that the conditions of the Chief Building Official's June 26, 1999 memo and the Parks Department's
August 3, 1999 memo shall be met;
7. that this landscaping variance, conditional use permits and conditional use permit amendment shall be
reviewed one year from the date of approval (August, 2000) and every two years thereafter; and
8. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as
amended by the City of Burlingame.
