RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND USE PERMIT FOR TAKE-OUT SERVICE
RESOLUTION-104-99
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for a
conditional useep rmit for take-out service at 1300 Howard Avenue, zoned C-1, Subarea B,
Kip Properties,12rWerty owner, Teresita Condon, applicant APN: 029-203-060;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
August 23, 1999 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission
that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no substantial
evidence that the project set forth above will have a significant effect on the environment, and
Categorical Exemption, per CEQA Section 15321 is hereby approved.
2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording
of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

Conditions of approval Categorical Exemption and Conditional Use Permit
1300 Howard Avenue
effective September 8, 1999
1. that the restaurant may not be open as a full food service business except during the
hours of 9 a.m. to 10 p.m. seven days a week with no more than 6 employees on site at
one time;
2. that the restaurant shall provide take out food service only during the hours in which
full food service is allowed and shall provide such take out food service only from a
counter no closer than 10 feet from any door or public right-of-way;
3. that this business shall not engage in any direct delivery of food prepared on this site
to customers; and
4. that any improvements for the use shall meet all California Building and Fire Codes, 1998
Edition as amended by the City of Burlingame.
