Date: 10.19.99 "C___ MargaA Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT RESO - 109 - 99 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit to operate a performing arts school at 1449 Oak Grove Avenue zoned R-3. APN: 029-100-370: First Church of Christ, property owner; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on October 13 1999, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per Article 19. 15301 -Existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. Q 40� C I, Stanley Vistica, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 13th day of October, 1999 , by the following vote: AYES: COMMISSIONERS: BOJUES, DREILING, KEIG11RAN, LUZURIAGA, VISTICA AND COFFER NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE ABSTAIN: COMMISSIONER DEAL SECRETARY IIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIII 28@ 02 1of 3 2:06P 13 EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 1449 OAK GROVE AVENUE effective October 18, 1999 1. that the performing arts school shall be limited to 2,319 SF on the first floor of the building at 1449 Oak Grove Avenue, as shown on the plans submitted to the Planning Department and date stamped August 20, 1999, Sheet l; 2. that the performing arts school may not be open for business except during the hours of 8:00 a.m. to 7:30 p.m. Monday through Friday, 10:00 a.m. to 7:30 p.m. Saturday, and closed on Sunday with a maximum of 53 people (part-time employees and students) on site at any one time; 3. that any changes in floor area, use, or number of employees or students, which exceeds the maximums as stated in these conditions shall require an amendment to this use permit; and 4. that the use and any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition, as amended by the City of Burlingame.
