Date: 12.7.99 Margar t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND AMENDMENT TO CONDITIONAL USE PERMIT RESO- 123-99 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a amendment to conditional use parMit forcage in operation to an existing car rental, storage and repair facily at 778 Burlway Road, zoned C-4, Dkbert Assoc. Ltd. , P.O. Box 359001 , Fort Lauderdale, FL 33�,propty owner, APN: 026-113-510; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 22, 1999 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1 . On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per Section 15301 , existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said amendment to conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such amendment to conditional use permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolutionrecorded in the offs 'al records of the County of San Mateo. C I, Ann Keighran , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 22nd day of November , 1999 , by the following vote: AYES: COMMISSIONERS: BOJUES , DEAL , DREILING , KEIGHRAN , VISTICA AND LUZURIAGA NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE 111111INIIIIIIIIIIIIIIIIIIIIIIIIIIII11II1IIIN 08/ 09122 02 40P 200 02 cIf14 13 SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and amendment to conditional use permit 778 Burlway Road effective December 6, 1999 1 . that the project shall operate as shown on the plans submitted to the Planning Department and date stamped September 30, 1999, Sheet A1 .0, site plan, and date stamped October 7, 1999, Sheet A1.0, tenant improvements for building A; 2. that the car rental, maintenance and storage facility may be open for business 24 hours a day, seven days a week, and that there shall no more than 15 full time employees and 10 customers on site at any one time; 3. that there shall be a maximum of 400 cars stored on the site at any one time, this number shall include a maximum of 125 vehicles on site for maintenance and there shall be a maximum of 2 car carriers on site to deliver vehicles, and that there shall be a maximum of 100 cars stored at the site at 1755 rsayshore Highway; 4. that no trucks delivering or picking up cars at this site shall arrive or depart between 7:00 a.m. and 9:00 a.m. or 4:00 p.m. and 6:00 p.m. daily, and all such deliveries shall be made on-site with no impact to the public street or right-of-way; 5. that two (2) handicap stalls for employees and/or visitors and two (2) handicap stalls for customer ready vehicles shall be provided and designated at 778 Burlway Road and while on site all other employees shall be required to park in the 30 space employee parking lot at the south end of the site, employee parking spaces shall be so designated and employee cars shall have stickers identifying them as belonging to employees on site; 6. that the loss of the use for auto storage of the site at 1755 Bayshore Highway shall cause the use permit for car rental use at 778 Burlway Road to be reviewed by the Planning Commission, the maximum number of cars to be stored at 1755 Bayshore Highway shall not exceed 100 without amendment to this ,,)ermit, this permit shall be reviewed if all cars delivered to 1755 Bayshore Highway are not loaded and/or unloaded on site; 7. that all employee parking shall be provided 24 hours a day, seven days a week at the south end of the site; 8. that the car rental operator at this site will pay to the City of Burlingame one percent of the gross rental for any vehicles for lease or rental originating from this site, whether those agreements are signed in Burlingame or adjacent jurisdictions (for this purpose the airport car rental facility shall not be considered for the 1 % payment to the City). Payments shall be made monthly, upon such forms as may be required by the City. In addition the City of Burlingame shall accrue any sales tax revenue from rental contracts written in the City of Burlingame. The car rental operation on this site shall keep and preserve, for a period of three (3) years, all records as may be necessary to determine the amount of said one percent payments. Such records shall be available for delivery to the City for review within fifteen (15) days after request therefore; IIIIIII Ilill !i!III!I '!Illllliill !III !IIIIII !!1! !II! e�®003 Q2 AOP Conditions of approval categorical exemption and amendment to conditional use permit 778 Burlway Road effective December 6, 1999 9. that auto storage shall total 400 at 778 Burlway Road; 10. that the conditional use permit for car rental use to write contracts, do minor maintenance and repair, and wash cars shall be granted only to this site with supplemental auto storage only at 1755 Bayshore Highway, no rental contracts shall be written nor rental cars picked up by customers at this supplemental storage site; 11. that no cars shall be loaded, unloaded or stored on any public street, in any public right-of-way, or in any public access area; 12. that any change to the rental of cars, number of employees, average number of cars rented from the site each month, amount of on-site or off-site auto storage, addition of services or secondary businesses to the site, or any other aspect of the operation of the car rental business at this location shall require an amendment to this use permit; 13. that the fire lane from the east end of the site to Burlway Road shall be provided and maintained, unobstructed, on a permanent basis as required by the Fire and Public Works Department of the City of Burlingame; 14. that the project shall be reviewed for compliance with these conditions every three years or upon complaint; and 15. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame. 634�3 IIIIIIIIlIII1111IIIIII1IIIIIIIIII!IIIIIIIIVIIIIIIIII e00 04oa� 3
