Date: 06.19..00 Uk Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION for DESIGN REVIEW AND SPECIAL PERMIT FOR AN ATTACHED GARAGE RESOLUTION-145-2000 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a Categorical Exemption has been proposed and application has been made for a design review permit to construct a second story addition at 164 Penner Avenue, zoned R-1, Walter and Angelika Haefeker, property owners, APN: 028-313-150; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on June 12. 2000, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: I. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per CEQA Section 15303 Existing Facilities, Class 3(e), construction and location of limited numbers of new, small facilities or structures including (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved is hereby approved. 2. Said design review permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such design review permit as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of thi esolution be recorn7- DAVE ecords of the County of San Mateo. LU A, I, Ann Keighran, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 12th day of June, 2000 , by the following vote: AYES: COMMISSIONERS: BOJUES, DEAL, DREILING, KEIGHRAN, OSTERLING AND LUSURIAGA NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: VISTICA ABSTAIN: COMMISSIONERS: ANN KEIGHRAN, S RETARY 1111 IN R1 Page:p 0002 0099046 EXHIBIT "A" Conditions of approval Categorical Exemption and Design Review 164 Pepper Avenue effective June 19, 2000 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped June 5, 2000, sheets A-lthrough A-4,- 2. -4;2. that any changes to the size or envelope of the residence, which would include changing the size or location of windows, or changing the roof height or pitch, shall be subject to design review; 3. that because the house is being developed to the maximum FAR with one covered parking space, the library area in this house shall not be converted to a bedroom which would require two covered parking spaces and an exception for FAR; 4. that the conditions of the City Engineer's January 3, 2000 and Chief Building Officia's June 8, 2000 memo shall be met; and 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame.
