Date: 08.31.00 it v 4QW L4 Marg et Mo oe, City P ann RESOLUTION APPROVING CATEGORICAL EXEMPTION AND AMENDMENT TO CONDITIONAL USE PERMIT RESOLUTION-158-2000 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for an amendment to conditional use permit for n incre? . in the number of employees for a phy io hP business (health service) in anemoting office .space at 340 Lorton AVP.n11P. dui e 203, zoned _2, Subarea B Don Sabatini 300 El-Portal Avenue, Burling, CA 94010 nroperty owner, APN 029-153-020; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 24, 2000 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15301, existing facilities, Class l(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said amendment to conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such amendment to conditional use permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. 1111IIII R1 Page:20002 013 6144 4CHA I, Ann Kei hran , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24th day of li y-, 2000 , by the following vote: AYES: COMMISSIONERS: Bojues, Deal, Keighran, Vistica and Luzuriaga NOES: COMMISSIONERS: None ABSENT: COMMISSIONERS: DREILING AND OSTERLING SECRETA EXHIBIT "A" Conditions of approval categorical exemption and amendment to conditional use permit 340 Lorton Avenue, Suite 203 effective August 7, 2000 1. that the physiotherapy business shall be limited to 374 SF in Suite 203, at 340 Lorton Avenue, as shown on the plans submitted to the Planning Department and date stamped June 20, 2000, Second Floor Plan, Sabatini Building, (8 '/2" x 11"); 2. that the physiotherapy business may not be open for business except during the hours of 8:00 A.M. to 10:00 P.M., seven days a week, with a maximum of one employee seeing clients, including the proprietor, on site at any one time; and that one therapist shall work Monday through Friday, 12:30 p.m. to 10:00 p.m., and the second therapist shall work Monday through Friday, 8:00 a.m. to 12:00 noon and 8:00 a.m. to 4:30 p.m. on weekends; 3. that all appointments by both therapists shall be scheduled so that there is a 15-minute interval between the time that one client leaves and the next client arrives; 4. that any changes to the operation, floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; and 5. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame.
