:SOLUTION APPROVING CATEGORICAL EXEMPTION, LOT COVERAGE VARIANCE,
AND CONDITIONAL USE PERMIT
RESOLUTION-213-2000
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been propdsed and application has been made for a lot
coverage variance and conditional use permit for and existing accessory structure at 1529 Ablemarle Way,
zoned R-1, APN: 025-228-350; Allen Menicucci, propeqy owner;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
December 11, 2000,at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
Article 19. 15303-Class 3-construction and location of limited numbers of new,small facilities or structures
including (a) single-family residences not in conjunction with the building of two or more such units. In
urbanized areas,up to three single-family residences may be constructed or converted under this exemption,
is hereby approved.
2. Said variance and conditional use permit are approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such variance and conditional use permit are as set forth in the
minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution e recorded in the official records
of the County of San Mateo.

Conditions of approval for categorical exemption, lot coverage variance, and conditional use permit.
1529 ABLEMARLE WAY
effective January 2, 2001
1. that the structure size and floor plan shall continue to be consistent with the plans submitted to the
Planning Department date stamped October 3, 2000;
2. that the use of this structure as living quarters shall cease and the bathroom portion shall be completely
removed in five years(December,2005)or a new application shall be made before this permit expires
to retain this use;
3. that the use in this structure shall be reviewed on an annual basis, by appointment with the
owner, to insure that the conditions of approval are complied with;
4. that the lot coverage variance being granted by the City .is based on the existing conditions
on the property, which were approved by previous permits, and that the variance is necessary
for the preservation and enjoyment of a substantial property right of the applicant, and
to prevent unnecessary hardship. Therefore, the lot coverage variance is applicable only
to the existing accessory structure, cannot be transferred to any other portion of the
property and will cease when any portion of the existing accessory structure is
removed.
5. that the conditions of the Building Official's October 10, 2000, memo shall be met and
separate application for a Building Department will be required before the accessory
structure can be utilized as living quarters; and
6. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 1998
Edition, as amended by the City of Burlingame.
