Date: 02.08.00 Lfk-('1&ak1 Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXENIPTION AND SIDE SETBACK VARIANCE RESOLUTION-31-2000 RESOLVED,by the Planning Commission of the City of Burlingame that: WHEREAS,a categorical exemption has been proposed and application has been made for a-jide setbackvariance for construction of a new cavort fora contractor's office and chop at 1405 North C rola an Avenue,zoned M-1, Atlas Plastering pro ely owners APN:026-101-070; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on Jamlaa 24 2000,at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW,THEREFORE,it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed,and comments received and addressed by this commission,it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment,and categorical exemption,per CEQA Article 19,Section 15301,existing Facilities, Class 1(e),additions to existing structures provided that the addition will not result in an increase of more than 50 percent of the floor area of the structures before the addition,or 2,500 square feet,whichever is less is hereby approved. 2. Said side setback variance is approved, subject to the conditions set forth in Exhibit"A" attached hereto. Findings for such side setback variance are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolutio recorded in the off ' records of the County of San Mateo. C I, Ann Keighran , Secretary of the Planning Commission of the City of Burlingame,do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24th day of January,2000,by the following vote: AYES: COMMISSIONERS: Bojues, Deal, Dreiling, Keighran, vistica, Osterling and Luzuriaga NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE SECCi`.T VIIIIIIIIIIIIII I 111111111 IIII 20002 0027 497 EXHIBIT "A" Conditions of approval categorical exemption and side setback variance 1405 North Carolan Avenue effective February 7, 2000 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped December 6, 1999, Sheets 1 through 6; 2. that the conditions of the City Engineer's December 8, 1999 memo shall be met; 3. that the following best management practices shall be adhered to during construction, failure to comply with these practices shall result in the requirement to install on-site pretreatment facilities prior to final inspection: a. store, handle, and dispose of construction materials and wastes properly, so as to prevent their contact with stormwater; b. control and prevent the discharge of all potential pollutants, including solid wastes, paints, concrete, petroleum products, chemicals, washwater or sediment, and non-stormwater discharges to storm drains and watercourses; C. use sediment controls or filtration to remove sediment from dewatering effluent; d. avoid cleaning, fueling, or maintaining vehicles on-site, except in a designated area in which runoff is contained and treated; e. delineate clearing limits, easements, setbacks, sensitive and critical areas, buffer zones, trees, and drainage courses with field markers; f. protect adjacent properties and undisturbed areas from construction impacts using vegetative buffer strips, sediment barriers or filters, dikes, mulching, or other measures as appropriate; g. perform clearing and earth moving activities only during dry weather; h. limit and time application of pesticides and fertilizers to prevent polluted runoff; i. limit construction access routes and stabilize designated access points; j. avoid tracking dirt or other materials off-site, clean off-site paved areas and sidewalks using dry sweeping methods; 4. that the following best management practices shall be adhered to during operation of the facility, failure to comply with these practices shall result in the requirement that the contracting business cease operation, that on-site pretreatment facilities shall be installed, and the application shall be reviewed by the Planning Commission and appropriate action taken to insure compliance: a. store, handle, and dispose of construction materials and wastes properly, so as to prevent their contact with stormwater; b. control and prevent the discharge of all potential pollutants, including solid wastes, paints, concrete, petroleum products, chemicals, washwater or sediment, and non-stormwater discharges to storm drains and watercourses; C. avoid cleaning, fueling, or maintaining vehicles on-site, except in a designated area in which runoff is contained and treated; d. limit and time application of pesticides and fertilizers to prevent polluted runoff; e. avoid tracking dirt or other materials off-site, clean off-site paved areas and sidewalks using dry sweeping methods; 2 IIIIIIIIiIIIIIIIIII IIIIIIIIII VIII VIIIIIIIIIIIIIII IIII /0003 00 8R 497 Conditions of approval categorical exemption and side setback variance 1405 North Carolan Avenue effective February 7, 2000 5. that the applicant shall install oil-absorbent pillow filters in the existing catch basins on site and shall change the filters every six months; and 6. that the property owner shall be responsible for cleaning up all the trash and refuse along the creek bank which front his ownership prior to receiving a building permit and shall be responsible for maintaining the creek bank area adjacent to his ownership in a natural state, complaints about the maintenance of this area or failure to maintain this area shall cause this conditional use permit to be reviewed by the Planning Commission; and 7. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame. 3 IIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIII�I 20000 11 :2T 49T ROUTING FORM DATE: December 7, 1999 TO: CITY ENGINEER _CHIEF BUILDING OFFICIAL FIRE MARSHAL SR.
