Date: 03.31.00 Marg )ret Mo oe, City Plar RESOLUTION APPROVING ONE-YEAR EXTENSION OF CATEGORICAL EXEMPTION AND PARKING VARIANCE AND CONDITIONAL USE PERMITS RESOLUTION-77-2000 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a one- year extension of the February 8, 1999 approval of parking variance and conditional is . p .rmit for-a restaurant and cocktail lounge in an existing boat in Sanchez Channel at 410 Airport Boulevard, zoned State of California, State Lands Commission, 1807 13t Street, Sacramento, CA 95814, 12roPertY owner, APN• 026-363-570: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on February 28, 2000 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15301, existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said one-year extension of parking variance and conditional use permits is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such one-year extension are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolutio be recorded in the o sial records of the County of San Mateo. CHA AN I, Ann Keighran , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 28th day of Few, 2040, by the following vote: AYES: COMMISSIONERS:, BOJUES, DREILING, KEIGHRAN, OSTERLING, VISTICA AND LUZURIAGA and DEAL NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE ABSTAINING COMMISSIONER: IIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIII ECRETARY 2000211:46A 3 EXHIBIT "A" Conditions of approval for one-year extension of categorical exemption, parking variance and conditional use permits 410 Airport Boulevard effective February 28, 2000 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped October 14,1998, Sheets 1 through 7, and date stamped January 8, 1999, Sheet 8; 2. that the conditions of the Chief Building Official's January 8, 1999 memo, the Fire Marshal's August 18, 1998 and January 7, 1999 memos and the City Engineer's August 17, 1998 memo shall be met; 3. that the restaurant and cocktail lounge may not be open for business except during the hours of 11:00 A.M. to Midnight, seven days a week, with no more than fourteen employees on site at any one time; 4. that the applicant shall obtain a permit from the Bay Conservation and Development Commission (BCDC), and shall provide an 8-foot wide public access walkway suitable for disabled access from the sidewalk on Airport Boulevard to the leasehold boundary; 5. that the final design of the observation platform shall be subject to review and approval by BCDC; 6. that the offices located in the top deck shall only be used in conjunction with the restaurant and cocktail lounge and shall not be rented or leased for a separate office use; 7. that any improvements for the use shall meet all California Building and Fire Codes, 1995 Edition as amended by the City of Burlingame; and 8. that if a building permit is not issued by February 17, 2001 for the improvements as described on the October 14, 1998 and January 8, 1999 plans approved by the Planning Commission amended as necessary to comply with the California 'Building and Fire Code of 1998 as amended by the City of Burlingame, then these exceptions shall be considered to have expired, and as required by the Burlingame Municipal Code, no further extension shall be allowed. 2 111111111IIII 06 06/20 20@03 006 3 6A 6833
