Date: 04.04.00 1 ► VIM 1�'l'Z� Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT AMENDMENT RESOLUTION-112-2000 RESOLVED,by the Planning Commission of the City of Burlingame that: WHEREAS,a categorical exemption has been proposed and application has been made for a conditional use permit amendment for an existing food establishment classified as a Limited Food Service Establishment and an increase in seating area at 1158 Capuchin Avenue zoned C-1 Broadway Commercial Area APN 026-211-270:David H and Anne H Hinkle Trs 1616 Sanchez Avenue Burlingame CA 94010 property owners; WHEREAS,said matters were heard by the Planning Commission of the City of Burlingame on March 27.2000'at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW,THEREFORE,it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed,and comments received and addressed by this commission,it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption,per Article 19. 15301-Existing Facilities,Class 1,operation of existing private structures involving negligible or no expansion of use beyond that previously existing is hereby approved. 2. Said conditional use permit amendment is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit amendment are as set forth in the minutes and recording of said meeting. 3. C I,Ann Keig ran,Secretary of the Planning Commission of the City of Burlingame, o hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 27th day of March,2000,by the following vote: AYES: COMMISSIONERS: BOJUES, DEAL, DREILING, KEIGHRAN, VISTICA, OSTERLING AND LUZURIAGA NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE SECRET aY 11111111TO111111111111111IT1111 060002 o06Pz2s EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit amendment. 1158 CAPucBiNo AvENuE effective April 3, 2000 1. that this business location presently occupied by a limited food service establishment, with 52 SF of on-site seating, may change its food establishment classification only to a full service restaurant or bar with approval of a conditional use permit for the establishment change; the criteria for the new classification shall be met in order for a change to be approved; 2. that the 52 SF area of on-site seating of the limited food service establishment shall be enlarged only by an amendment to this conditional use permit; 3. that the applicant shall provide daily litter control along all frontages of the business and within fifty (50) feet of all frontages of the business; 4. that there shall be no food sales allowed at this location from a window or from any opening within 10' of the property line; 5. that if this site is changed from any food establishment use to any other retail use, a food establishment shall not be replaced on this site and this conditional use permit shall become void; 6. that an amendment to this conditional use permit shall be required for delivery of prepared food from this premise; 7. that the sale of food and beverages shall be limited to coffee, refrigerated drinks and cold food and a full kitchen shall not be installed; 8. that the coffee shop may be open 5:00 a.m. to 8:00 p.m. Monday through Sunday with a maximum of two employees at any one time; 9. that this business shall provide and maintain trash receptacles outside the door at a location approved by the City Engineer and Fire Department; and 10. that the project shall meet all the requirements in effect at the time of the California Building and Fire Codes, and as amended by the City of Burlingame.
