Luzuriaga ANN KEI , SECRETARY EXHIBIT "A" CONDITIONS OF APPROVAL CATEGORICAL EXEMPTION, CONDITIONAL USE PERMIT, DESIGN REVIEW AND SPECIAL PERMITS FOR HEIGHT 2100 POPPY DRIVE effective May 1, 2000 1. that the project shall be built as shown on the plans submitted tot he Planning Department and date stamped Lot A November 30, 1999 and Lot B January 31, 2000, except that the garage and house as shown in the submitted plans for Lot B shall be move 2'-0"to the rear of the lot, maintaining the same separation between the two structures; 2. that after receiving a permit from the Parks Department for removal of the protected sized pine tree at the rear of Lot B and prior to receiving a building permit for construction of the house on Lot B, the applicant shall removed the pine tree and shall plant a replacement tree on site at a location approved by the City Arborist; development on both lots shall comply with the city's reforestation ordinance; 3. that the placement of the new trees required under the city's reforestation requirements and the replacement for the protected pine tree shall be based on creating the same canopy effect at maturity of the trees as is now created by the pine tree for the adjacent properties, the location selected for the replanted trees shall be approved by the City Arborist to determine that the canopy effect created will be similar; 4. that the existing house and detached garage shall be demolished prior to recording the lot line adjustment; 5. that the lot line adjustment shall be recorded prior to issuing a building permit and copy of the recorded document shall be submitted to the Department of Public Works prior to issuance of the building permit and all other requirements of the Department of Public Works memo dated March 28, 2000; 6. that a property survey setting all corners of each lot will be required when a building permit is applied for to determine the property line locations; 7. that during demolition, site preparation and construction of both new houses, the applicant shall comply with the requirements of Burlingame's Storm Water Ordinance by implementing appropriate"best management practices: to ensure the site is well protected and managed to prevent sediment and erosion of storm water runoff. Should the Commission decide to approve this application the attached conditions need to be attached: 1. The existing house shall be demolished prior to recording to meet zoning requirements. Also, staff wishes to advise the applicant that: 1. The lot-line adjustment shall be recorded prior to issuing a building permit and a copy of the record shall be sent to the City. 2. A property survey setting all corners will be required when a building permit is applied for either lot to determine the property line locations. 3. The development of Lot A & Lot B will be under design review by the Planning Commission including the effects of site development,proposed paving, irrigation and storm drainage. Background: This application is to subdivide existing Lot 8, Lot 9, and a portion of Lot 10 into two new lots (Lot A & Lot B). Lots 8, 9 and a portion of Lot 10 were created in 1943 prior to any City Ordinances requiring approval and before the Map Act covered less than a five (5) lot subdivision. The existing site consists of two non-conforming lots and a portion of a lot that is also non- conforming. All these lots will be developeable without the lot-line adjustment. A parcel map is not required to split this land from three (3)parcels into two (2). Page -1- The current Subdivision Map Act Section 66412 Map Act Exclusions (d) states: "A lot line adjustment between two or more existing adjacent parcels, where the land taken from one parcel is added to an adjacent parcel, and where a greater number of parcels than originally existed is not thereby created, provided the lot line adjustment is approved by the local agency, or advisory agency. A local agency or advisory agency shall limit its review and approval to a determination of whether or not the parcels resulting from the lot line adjustment will conform to local zoning and building ordinances. An advisory agency or local agency shall not impose conditions or exactions on its approval of a lot line adjustment except to conform to local zoning and building ordinances, to require the prepayment of real property fees prior to the approval of the lot-line adjustment, or to facilitate the relocation of existing utilities, infrastructure, or easements. No tentative map,parcel map, final map shall be required as a condition to the approval of a lot line adjustment. The lot line adjustment shall be reflected in a deed, which shall be recorded. No record of survey shall be required for a lot line adjustment unless required by Section 8762 of the Business and professions Code." The proposed Lot A will have 73.96' frontage with an area of 6,875 square feet. The proposed Lot B will have 61.04' frontage and an area of 6,164 square feet. These parcels meet all zoning requirements. The Planning Department has reviewed this map and their comments are attached. There are no public utilities nor public easements that will be affected and this application can be approved by the Commission. The issues addressed in the Planning Department staff report include: 1)the conditional use permit for the demolition of the existing house which would then unmerge the three(or two and a half)lots at 2100 Poppy Drive;2)design review for the two new two-story houses;3)special permits for height for both houses,and 4)a variance for the second storyfront setback of the new house proposed on Lot B. The design of the new houses has been reviewed by a Design Review Consultant who has recommended approval of the project. Planning Commission's action and approval of these applications is scheduled for the public hearing on March 27,2000,pending the acceptance of the application materials by the Department of Public Works and Planning Department. Planning staff has reviewed the boundary and topographic survey which identifies the footprint of the existing house,old parcel lines,proposed new parcel lines,and the footprints and setbacks of the proposed new houses. Planning staff has determined that this tentative map,as proposed,is acceptable,however,it should be noted that the new house on Lot B(interior lot)includes an application for a variance because the second story(not outlined on the map)does not meet the minimum setback of 20'-0" from the front property line. This setback variance is specific for the design of the new house proposed on this site;but other single family homes could be designed to meet the R-1 zoning standards. Planning staff has determined that the proposed boundary and topographic survey conforms with the R-1 zoning standards. It would have been helpful for the applicant to identify the size(square footage)of the existing and proposed lots included in the lot line adjustment. The draft staff report for this project will be available on Monday,March 20,2000 with the final report ready for distribution on March 22,2000.
