RESOLUTION NO. 94-64
A RESOLUTION OF INTENTION TO ACQUIRE AND
CONSTRUCT IMPROVEMENTS
BAYSIDE IMPROVEMENT DISTRICT
RESOLVED, by the City Council of the City of Burlingame,
California, that in its opinion the public interest and convenien
require and that it is the intention of said Council to order the
following acquisitions and improvements, to wit:
1. (a) Broadway-Bayshore area:
(i) The opening and improving of Carolan Avenue
from Toyon Drive to Broadway by grading and the construction
therein of base pavement and wearing surface, Portland cement
concrete curbs, gutters and sidewalks, and storm drainage pipes,
catch basins and appurtenances.
(ii) The opening and improving of Industrial Way
from Carolan Avenue to Bayshore Boulevard by grading and the
construction therein of base pavement and wearing surface, Port-
land cement concrete curbs, gutters and sidewalks, storm drain
pipes, catch basins and appurtenances and street lighting facili-
ties.
(iii) The widening of Bayshore Boulevard from
Industrial Way southeasterly to the southeasterly boundary of
the lands of Burlingame Shore Land Co. by the acquisition of an
additional ten feet of right of way along said frontage and the
improving thereof by grading, removal of existing curb and gutter,
and reconstruction of Portland cement concrete curbs, gutters,
sidewalks, base pavement and wearing surface and street lighting
facilities.
(iv) The construction of a concrete box culvert
in the existing.open ditch from Carolan Avenue to Bayshore Boule-
vard.
(v) The relocation and reconstruction of sani-
tary sewers, manholes, and appurtenances necessary to accommodate
to the proposed improvements, together with the construction of
all work and the acquisition of all easements auxiliary to any of
the above and necessary to complete same.
(b) Airport Boulevard area:
(i) The opening and improving of Airport Boule-
vard from near Burlingame Avenue northerly about 420 feet and
the opening and improving of A Street from Airport Boulevard
westerly about 770 feet, and the improving thereof by grading
and the construction therein of base pavement and wearing surface,
Portland cement concrete curbs, gutters and sidewalks, storm drain
(main from said pumping station southerly to and across Bayshore
Freeway to B' ore Boulevard, thence west- y in Bayshore Boule-
vard to an e ing manhole at Dwight Roe
(iii) The acquisition of all easements and the con-
struction of all improvements auxiliary to any of the above and
necessary to complete the same.
(c) Water distribution and transmission facilities:
(i) The construction of water mains, valves, hydrants,
services and appurtenances in Carolan Avenue from Toyon Drive to
Broadway, and in Industrial Way from Carolan Avenue to Bayshore
Boulevard, thence southeasterly in Bayshore Boulevard to Toyon
Drive, across Bayshore Freeway at the Sanchez Creek culvert,
thence northeasterly and easterly across the lands of the City of
Burlingame to the westerly boundary of Reclamation District No.
2097, thence southerly and easterly along the southerly boundary
of said Reclamation District to and along proposed A Street to
proposed Airport Boulevard, thence southerly along Airport Boule-
vard and its southerly extension to and across Bayshore Freeway
to Bayshore Boulevard, thence southeasterly in Humboldt Street to
an existing main of the City of Burlingame, together with the
acquisition of all easements and.the construction of all improve-
ments auxiliary to any of the above and necessary to complete the
same.
2. Whenever any public way is herein referred to as running
between two public ways, or from or to any public way, the inter-
sections of the public ways referred to are included to the
extent that work shall be shown on the plans to be done therein.
3. Said streets and highways are more particularly shown
in the records in the office of the County Recorder of San Mateo
County, California, and shall be shown upon the plans herein re-
ferred to and to be filed with the City Clerk of said City.
4. All of said work and improvements are to be constructed
at the places and in the particular locations, of the forms,
sizes, dimensions and materials, and at the lines, grades and
elevations as shown and delineated upon the plans, profiles and
specifications to be made therefor, as hereinafter provided.
5. There is to be excepted from the work herein described
any of such work already done to line and grade and marked except-
ed or shown not to be done on said plans, profiles and specifica-
tions.

7. Said Council'does hereby adopt atd:establish as the
official grades for said work the grades and elevations to be
shown upon said plans, profiles and specifications. All such
grades and elevations are to be in feet and decimals thereof
with reference to the datum plane of the City of Burlingame.
8. The descriptions of the acquisitions and improvements
and the termini of the work contained in this Resolution are
general in nature. All items of work do not necessarily extend
for the full length of the description thereof. The plans and
profiles of the work, and maps and descriptions as contained in
the Engineer's report, shall be controlling as to the correct
and detailed description thereof.
9. Said contemplated acquisitions and improvements, in
the opinion of said Council, are of more than local or ordinary
public benefit, and that the cost of the improvements described
in subparagraph 1 (a) above, together with expenses incidental
thereto, be assessed upon the properties within the area bounded
by Toyon Drive, Carolan Avenue extended northwesterly, Broadway
and Bayshore Boulevard; provided, that the amounts of any assess-
ments which would otherwise be levied against Parcels Numbered
7 and 24 on the map hereinafter referred to shall be levied
against the lands of Burlingame Shore Land Co.; that the costs
of the improvements described in subparagraph 1 (b) above, to-
gether with expenses incidental thereto, be assessed upon the
properties within the boundaries of Reclamation District No.
2097, together with the lands of Crocker-Anglo National Bank

between the Bayshore Freeway and said Reclamation District insofar
as the sanitary sewerage facilities are concerned; and that the
costs of the improvements described in subparagraph 1 (c) above,
together with the expenses incidental thereto, be assessed on the
lands shown on a map entitled "Preliminary Assessment Diagram,
Bayside Improvement District", dated June, 1964, on file in the
office of the City Clerk, which indicates by a boundary line the
extent of the territory included in the proposed district and
which shall govern for all details as to the extent of the assess-
ment district.
10. Said Council further declares that all public streets
and highways and lots or parcels of land owned by the City of
Burlingame within said assessment district and in use in the per-
formance of a public function as such shall be omitted from the
assessment hereafter to be made to cover the costs and expenses
of said acquisitions and improvements,
11. Notice is hereby given that serial bonds to represent
unpaid assessments and bear interest at the rate of not to exceed
six percent (6%) per annum, will be issued hereunder in the mann
provided in the Improvement Act of 1911, Division 7 of the Streets
and Highways Code, the last installment of which bonds shall mature
not to exceed nineteen (19) years from the second day of January
next succeeding the next September lst following their date. Said
bonds shall be made payable to bearer and provide a premium of five
per cent (5%) of the unmatured principal thereof on call.
12. Except as herein otherwise provided for the issuance of
bonds, all of said improvements shall be done pursuant to the
provisions of the Municipal Improvement Act of 1913.

ments to be made pursuant to this Resolution of Intention;
(c) Engineer's statement of the itemized and total
estimated costs and expenses of said acquisitions and improvements
and of the incidental expenses in connection therewith;
(d) Diagram showing the assessment district above
referred to, and also the boundaries and dimensions of the respec-
tive subdivisions of land within said district as the same existed
at the.time of the passage of this Resolution of Intention, each
of which subdivisions shall be given a separate number upon said
diagram;
(e) A proposed assessment of the total amount of the
costs and expenses of the proposed acquisitions and improvements
upon the several subdivisions of land in said district in pro-
portion to the estimated benefits to be received by such subdi-
visions, respectively, from said acquisitions and improvements,
and of the expenses incidental thereto.
15. If any excess shall be realized from the assessment
it shall be used, in such amounts'as the Council may determine,
in accordance with the provisions of law for one or more of the
following purposes:
(a) Transfer to the general fund of the City provided
that the amount of any such transfer shall not exceed the lesser
of $1,000 or 50 of the total amount expended from the improvement
f und;
(b) As.a credit upon the assessment and any supple-
mental assessment; or
(c) For the maintenance of the improvements.
