A RWOLUTION APPOINTING ENGIM", AND ATTORNEYS
BAYSIDE IMPROVEMENT DISTRICT
RESC)LVMD, by the City Council of the City of Burlingame,
California, that
WigMAS, this Council has deterialned to undertake pro-
ceedings pursuant to appropriate azaessment and assessment bond
acts for the acquisition and construction of public improvements

the preparation and conduct of said proceedings and work In
connection with said acquisitions and improvemental-

he In hereby, appointed as Englneer of Work, to do and perform
all eng.jneering work necessary in and for said proceedinga., with
aoinpenzation to be fixed as follOWS:
(a) All prel. jLn _jnary surveying, preparation of
plans, profiles, specificationso estimate of costs, diagram and
assessmento maps and descriptions of easements to be acquired,
appearances at hearings, setting grade and alignment stakes,
supervision of work and preparing, signing and filing of cost
certificates, with compensation therefor fixed at the lump swin
of $23s5OO;
(b) If the city assigns the function of con-
struction inspection to the Engineer of work, compensation there-
for shall be the l=ip swx of $4,000; provided that the specifi-
cations and contract documents may provide for additional
compensation payable by the contractor in the form of liquidated
dama6es In the event that the work is not completed within the
time allowed therefor;
(a) Soils engineerV6 services will be performed
b, a recognized soils engineer to be employed by the Engineer cr
Work subject to the approval of the City EnGincer, at fees esti-
mated at $3,500; provided, however, that any extra soils en-
gineering fees and casts over wid above said estimate shall be
the responsibility of the assessment district and not the Enaineer
of Work.
2. The City Engin be, and he Is hereby, authorized and
directed K examine and approve all engineering documents and to
provide the iaspection of the installation of said improvements
usual for his office.
3, That Wilson, Harzfeld, Jonea & Morton, San Nhteo, Ca-
lifornia. be, and they are hereby, appointed and employed to do
and perform all legal services required in the conduct of said
proceedings, includinL,, the preparation of all papers not required
to be prepared by the Engineer (exclusive of printing), examining
and approving the engimering documents as to legal sufficiency,
and advising the Engineer In the preparation of his work, ad -
AN, all City officials on all matters relating thereto when
called upon, aQ furnishing their legal opinion on the validity
of said proceedings and bonds; and that their compensation be
fixed at two per cent (J) of the cost of the project, exclusive
of Incidental expenses. It is Intended that said percentage fees
constitute full compensation for all legal services required to
aecomplAh said project, except for litigation (other than vali-
dating suits prosecuted on the recommendation of said attorneys)
and eminent domain proceedings. In the event ouch work is re-
ferred N said attorneys, compensation therefor shall be based
