HomeMy WebLinkAboutReso - CC - 096-1964RESOLUTION NO. s -64 ORDERING THE VACATION OF A PORTION OF BAYSHORE HIGHWAY, A PUBLIC STREET WITHIN THE CITY OF BURLINGAME RESOLVED, by the City Council of the City of Burlingame, California, that �4HEREAS, said City Council did on the 6th day of July, 1964, adopt its certain Resolution No. 82-64 declaring its intention to vacate a certain portion of the Bayshore Highway, a public street within the City of Burlingame, which said portion of said street is particularly described as follows: All that certain real property situate in the City of Burlingame, County of San Mateo, State of California, described as follows: BEGINNING at the most Southerly corner of Lot 2 as shown on the map entitled "SMALLCOMB INDUSTRIAL PARK BURLINGAME SAN MATEO COUNTY CALIFORNIA", which map was filed in the office of the Recorder of the County of San Mateo, State of California on April 15, 1957 in Book 47 of Maps at page 15; said point also being the most westerly corner of Parcel One as described in the Deed to Elmo E. Phillips and wife, dated September 20, 1961 and recorded September 26 1961 in Book 4061 of Official Records of San Mateo County at page 483 (98743-T); thence from said point of beginning South 67a 59' West 20.5 feet; thence South 22° 01' East, parallel to the Southwesterly line of the lands described in the last mentioned Deed 327.01 feet; thence North 67° 59' East 20.5 feet to the most Southerly corner of Parcel Three described in said Deed; thence North 22' 01' West along the Southwesterly boundary line of the lands des- cribed in said Deed (called North 22*01'40""West in said Deed) 327.01 feet to the point of beginning. WHEREAS, said resolution recited that said proceedings were being taken under and pursuant to the STREET VACATION ACT OF 1941, and expressed its election to proceed under said Act; and WHEREAS, said resolution was duly adopted and published in the time, manner and form provided by law, all as appears from an affidavit of publication on file in the office of the City Clerk of said city; and WHEREAS, notices of street vacation were conspicuously posted in the number and at the places and in the manner required by law, which said notices stated the time and place of hearing, and the adoption of said Resolution No, 82-64; and WHEREAS, it appears that all other manner of things required by law were done and performed in the time and in the manner required by law; and WHEREAS, Monday, the 3rd day of August, 1964, at 8:00 o'clock p.m, at the Council Chambers of the City Council in the City Hall in the City of Burlingame were fixed in said resolution as the time and place for hearing all persons interested in the proposed vacation of said portion of said public street and also for hearing all persons wishing to object to said proposed vacation; and IJHEREAS, after hearing the evidence, the City Council finds ++ from all evidence submitted that the portion of Bayshore Highway, a public street, hereinabove described, is unnecessary for present! or prospective public street purposes; and NOW, THEREFORE, IT IS HEREBY ORDERED that that certain portion of Bayshore Highway, a public street within the City of Burlingaire,hereinabove particularly described, be, and it is hereby, vacated.
