RESOLUTION NO. 82 - 64
DECLARING INTENTION TO VACATE PORTION OF BAYSHORE HIGHWAY,
A PUBLIC STREET WITHIN THE CITY OF BURLINGAME; REFERRING
TO A MAP OR PLAN ON FILE IN THE OFFICE OF THE CITY CLERK
FOR PARTICULARS AS TO THE PROPOSED VACATION; AND FIXING
THE TIME AND PLACE FOR HEARING ALL PERSONS INTERESTED IN
OR OBJECTING TO THE PROPOSED VACATION
RESOLVED by the City Council of the City of Burlingame:

1. That the public interest and convenience require and
that it is the intention of the said Council to vacate certain
j� portions of the Bayshore Highway, a public street within the City
of Burlingame, which portions are particularly described in the
exhibit attached to, incorporated in, and made a part of this
i
resolution by reference.
2. A map or plan showing and delineating the portion of

said street proposed to be vacated under these proceedings and
i
! the easements proposed to be reserved and excepted from such
vacations entitled "BAYSHORE HIGHWAY STREET VACATION -- PHILLIPS" `
!i is on file in the office of the City Clerk, and reference is here-!
by made to said map or plan for particulars as to said vacation.
3. The City Council elects to proceed under the provisions
of the STREET VACATION ACT OF 1941. !
it 4. NOTICE IS HEREBY GIVEN that Monday, the 3rd day of
August, 1964, at 8:00 o'clock p.m, at the Council Chambers of

the City Council in the City Hall in the City of Burlingame is
IIhereby fixed as the time and place for hearing all persons in -
it terested in the proposed vacation of said portion of said public
i!
street.

5. The Clerk of said city shall cause this resolution to
be published once in the ADVANCE -STAR, a newspaper of general
ij
circulation published in and circulated in said city which said
h
newspaper is hereby designated for that purpose.

6. At least ten days before the date set for hearing, the
Director of Public Works of said city shall cause to be conspicu-
ously posted along the lines of that portion of said public street
proposed to be vacated at least 3 notices of vacation, not more
than 300 feet apart, stating the time and place of hearing and
the passage of this resolution.
I, Herbert K. White, City Clerk, do hereby certify that the
foregoing resolution was introduced and adopted at a regular
meeting of the City Council held on the 6th day of July ,
1964, by the following vote:
Ayes: Councilmen: Crosby-Diederich sen-George -John son -Mart in.
Noes: Councilmen: None
Absent Councilmen: None

All that certain real property situate in the City of Burlingame,
County of Sari j"JIateo, State of California, described as follows:
BEGINATING at the roost Southerly corner of Lot 2 as s4:ot>n on the
rip entitled "SMALLCOI,:3 INDUSTRIAL PARK BURLIIE.A'rM SA M MATZO COUIITF
CALIF OR TIA", which map was filed in the office of tl=.c Recorder of
the County of San 1Iateo* State of California, on April. 1.5, 1957 in
Book 47 of Daps at page 15; said point also being the most ire;sterly
corner of Parcel One as described in the Deed to Elmo D. Phillips
and wife, dated September 20, 1961 and reoorded September 26, 19161•'
in Book 4061 of Official Records of San Mateo County at P9e 483
(98743-T); thence from said point of beginning South 67' 50.P West
20.5 feet; thence South 22' Oil East, parallel to the SaLthwesterly
line of the lands described in the last mentioned Deed 327.01 feet;
thence North 67° 591 East 20.5 feet to the most Southerly corner of
Parcel Three described in said Deed; thence North 220 011 West along
the Southvmesterly boundary line of the lands described in said Deed
(called North 226 01! 40'' Feat in said Heed) 327.01 feet to the point
of beginning.

The undersigned, GEORGE J. MARR, of the City of Burlingame,
California, being duly sworn, deposes and says:
That at all times mentioned in this affidavit he was and
now is the duly appointed, qualified and acting Director of
Public Works of the City of Burlingame;

That on the day of July, 1964, he caused to be posted
copies of the attached 'NOTICE OF STREET VACATION" along the line.c
of that portion of the Bayshore Highway, a public street in the
City of Burlingame, which is identified in the map or plan
entitled "BAYSHORE HIGHWAY STREET VACATION -- PHILLIPS" which
map or plan is on file in the office of the City Clerk of said
City, and which portion of said public street is particularly
described in Resolution No. 82-64 adopted by the City Council of
said City on July 6, 1964; and
That said copies of said Notice of Street Vacation were
posted not more than three hundred (300) feet apart and at
least three (3) copies of said Notice were posted along the
line of said portion of said public street proposed to be vacated,
