HomeMy WebLinkAboutReso - CC - 064-1964JEL:jw 320/1B RESOLUTION NO. 64-64 A RESOLUTION ACCEPTING QUIT CLAIM DEED AND AUTHORIZING PAYMENT THEREFOR RESOLVED, by the City Council of the City of Burlingame California, that John E. Lynch of the law firm of Wilson, Harz- feld, Jones & Morton, who, along with the City Attorney of the City of Burlingame, are attorneys for record for the City of Burlingame, in that certain action entitled, "CITY OF BURLINGAME v. ELSIE E. BARDET, et al," Action No. 103119, in the Superior Court of the State of California, in and for the County of San Mateo, be, and he is, hereby authorized and directed to accept, in behalf of said City, the quit claim deed heretofore deposited into escrow with Title Insurance and Trust Company by the tenant of Parcel 1B, Virgil E. Orcutt, Jr., said Parcel 1B being more particularly described in the aforesaid condemnation action, said'. quit claim deed to be recorded and delivered to the City of Burlingame upon payment to said tenant, Virgil E. Orcutt, Jr., of the sum of $1,600. IT IS FURTHER RESOLVED, that the City Clerk is author- ized and directed to draw his warrant forthwith in the sum of $1,600, payable to Virgil E. Orcutt, Jr., and deliver said warrant to the attorneys aforesaid at 630 North San Mateo Drive, San Mateo, California. PASSED AND ADOPTED by the following vote this 4th day of May , 1964. WALLACE 320/1B et al (Parcel r wGr At the Council meeting of April 20, 1964, the undersigned was authorized to accept the offer of the owners of the above -designated parcel for the sum of $60,000, which has been done. Through an inadvertence, we neglected to inform you of an outstanding leasehold interest of the tenant, Virgil E. Orcutt, Jr., on a portion of the parcel, which ran to October 25, 1966. The negotiator settled the tenant's interest for the sum of $1,600. Mr. Orcutt has deposited a quit claim deed in escrow with instructions that the City can record the deed upon payment to him of the sum of $1,600. Authority is, therefore, requested to settle the tenant's interest in that sum. A resolution to that end is enclosed. Thank you for your courtesy in this matter.
