RESOLVED, by the City Council of the City of Burlingame, California, that JOHN E. LYNCH, of the law firm of WILSON,JONES, MORTON &.LYNCH, who, along with the City Attorney of the City of Burlingame, in that certain action entitled, "City of Burlingame v. Elsie E. Bardet, et al.", Action No. 103119, in the Superior Court of the State of California, in and for the County of San Mateo, be, and he is, hereby authorized and directed to accept, on behalf of said City, the Offer to Sell, a conformed copy of which is attached hereto, and by this reference incorporated herein, heretofore submitted by the owners of Parcel 3-H, as mos particularly described in said Offer, and to close said trans- action in accordance with the terms and procedures set forth in said Offer. IT IS FURTHER RESOLVED that the City Clerk is authorized and hereby directed to draw his warrant forthwith in the sum of $27,500.00, payable to GEORGE J. ZUCCA, ROBERT F. ZUCCA and T. P. ZUCCA, and deliver said warrant to said John E. Lynch, o30 North San Mateo Drive, San Mateo, California. PASSED AND ADOPTED by the following vote this 21 day of June 1965. For and in consideration of the sum of $1.000 receipt of which is hereby acknowledged, the undersigned offer to sell to the City of Burlingame, a municipal corporation, that certain parcel of land a'ituate in the City of Burlingame, County of San Mateo, State of California, and more particularly described as follows: A portion of Lots 2 and 3. B1oc►c 3, as designated on the map entitled "MAP OF SUBDIVISION NO. 2 OF BURLINGAME PARK, CAL.", which map was filed in the orfice of the Recorder of the County of San Mateo, State of California on October 15, 1905 in Book "B" of I -laps at page 17, and a copy entered in Book 3 of Paps at page 77, more particularly described as follows: ;Beginning at a point on the SWrly line of the County Road, distant thereon 105 feet Nally from the point of intersection thereof with the Nally line of Ralston Avenue, as said road and avenue appear -- - on the map above referred to; said point of beginn- ing being the most Northerly corner of that parcel of land conveyed by Robert Henry and Robina J. The purchase price shall be the sum of $27,500.00. Title to said parcel shall be delivered free and clear of all liens and encumbrances of every nature with the exception of easements for public utilities purposes. The purchase price sha.1 be delivered into escrow, with the appropriate escrow instructions consistent with the terms of this offer, within 20 days after acceptance of this offer. This offer shall be irrevocable for a period of 45 days. City shall bear cost of escrow, if any, and policy of title insurance.
