A RESOLUTION AUTHORIZING SETTLPMENT OF PARCEL 7-C(Wurlitzer)
PARKING DISTRICT NO. 1.
RESOLVED, by the City Council of the City of Burlingame,
California, that JOHN E. LYNCH, of the law firm of WILSON, HARZFEL
JONES & MORTON, who, along with the City Attorney of the City of
Burlingame, ai•e a.ttorn,-ys of record for the City of Burlingame,
in that certain actin entitled, "CITY OF BURLINGAME v. ELSIE E.
BARDET, et al.," Action No. 103119, in the Superior Court, of the
State of California, in and for the County of San Mateo, California
be, and he is, hereby authorized and directed to accept, in behalf
of said City, the Offer to Sell, a conformed copy of which is att
ed hereto, and by this reference incorporated herein, heretofore
submitted by the owner of Parcel 7-C, as more particularly des-
cribed in said Offer, and to close said transaction in accordance
with the terms and procedures set forth in said Offer.
PASSED and ADOPTED, by the following vote, this 19t6ay of
April �1965.

For and in consideration ofthe sum of $1.00, receipt -
of which is hereby acknowledged, the undersigned offer to sell
to the City of Burlingame, a municipal corporation, an easement
in 'behalf of the public, for pedestrian and vehicular travel to
be used in common with the existing easements of the undersigned
in and to the parcel aforesaid, in, ove. , across and upon that
certain parcel of land situate in the Cly of Burlingame, County
of San Mateo, State of California, and more particularly described
as follows

G11NTNiNG on the NEly line of Prirwose Road, as said
line was established by Deeds from Eva Marlon Farnan
to City of Burlingame, a municipal corporation, dated
September 20, 1929 and recorded December 16, 1929
In Book 453 of Official Records of .:air Mateo County,
at page 65 and from Martin Stelling, Jr., and wife,
dated October 18 1929 and recorded December 16,
1929 in Book 452 of Official Records of Sat) Mateo
County, at page 105, said point of beginning being dis-
tant along said Northeasterly line Northwesterly
112 feet from the Northwe temly line of Burlingame
Avenue, as said Avenue is show, ` n the map entitled,
"MAP NO. 2 OF THE PROPERTY OF Tll BURLIN A.7, LAND
vu. ,'- N 14ATEO COUNTY, CAL., which map was
filed in the office of the Reco: dei of the County
of San Mateo, State of California on February 20,
1905 in Book "D" of maps at page 38 and a copy
entered it Book 3 of Mpps, at page 55; thence
from saidpoint of beginning Northwesterly along said
line of Primrose Road, 8 feet; thence Northeasterly,

1 parallel with the said Northwesterly line of
Burlingame Avenue, 50 feet; thence Southeasterly
2 parallel with the said Northeasterly line of
Primrose Road 8 feet; thence Southwesterly,
3 parallel with the said Northwesterly line of
Burlingame Avenue, 50 feet to the point of
4 beginning.
5 It is specifically understood, that there shall be
6 reserved to the undersigned and their heirs, successors and
7 assigns, their existing easements for pedestrian and vehicular
8 travel in, over, across and upon the parcel aforesaid.
9 It is also specifically understood that the under-
10 signed, their heirs, successors and assigns, have reserved
11 and retained all rights in said Parcel 7-C not inconsistent
12 with the exercise of the easement granted herein, including
13 subsurface rights and all air rights above a height
14 feet from the present ground level of said Parcel 7-C at said
15 northeasterly line of Primrose Road.
