RESOLUTION NO. 11-94
PLEASE RETURN RECORDED RESOLUTION APPROVING CATEGORICAL EXEMPTION
COPY TO: AND SPECIAL PERMIT
PLANNING DEPARTMENT
CITY OF BURLINGAME RESOLVED, by the Planning Commission of the City of Burlingame that:
501 PRIMROSE ROAD WHEREAS, a categorical exemption has been proposed and application
BURLINGAME, CA 9401(pas been made for a special permit for a satellite dish antenna located
on the roof at 221 Park Road (APN 029-203-050) ; _(property owner: Malcolm
J. Cohn, Harmonious Holdings Inc 144 Brentwood Drive South San
Francisco, CA) , and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on February 14, 1994 , at which time it reviewed
and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
categorical exemption Section 15303 - New Construction or Conversion of
Small Structures Class 3(e) , Accessory (appurtenant) structures including
satellite dish antennas is hereby approved.
2. Said special permit is approved subject to the conditions set
forth in Exhibit "A" attached hereto. Findings for such Special Permit
are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.

EXHIBIT "A"
Conditions of approval, categorical exemption and special permit
221 Park Road
(effective February 23, 1994
1. that the satellite dish antenna shall be installed as shown on the
plans submitted to the Planning Department and date stamped January
13 , 1994, Site Plan;
2 . that the conditions of the Chief Building Official' s memo dated
January 18, 1994 shall be met; that installation of this satellite
dish requires separate application to the Building Department, with
proper plans and calculations, as required for a Building Permit;
3 . that the antenna dish installed shall not have a diameter greater
than 7 ' -011 , nor rise more than 8 ' -0" above the surface of the roof,
be painted with a nonreflective paint, smoky gray in color to match
the roof;
4 . that the applicant or property owner shall be responsible for an
amendment to this use permit if future construction on any adjacent
property requires reliction of the dish antenna, removal and
reinstallation costs shall also be borne by the applicant and/or
property owner;
5 . that the applicant shall permanently maintain the nonreflective
surface of the dish and its support structure, or remove all the
equipment and support structure;
6. that as installed the satellite antenna shall meet all the
requirements of the Uniform Building and Uniform Fire Codes,
including connections from the antenna inside the building to the
television equipment;
7 . that the satellite antenna shall be removed at the time this tenant
leaves this premiss and if the new tenant wishes to install any
type of antenna he shall comply with all the code requirements in
effect at that time;
8 . that the current antenna shall be removed from its present location
within 30 days of the approval date of this application; and
9 . that any modification to the antenna or its location shall require
an amendment to this use permit.
