RESOLVED, by the Planning Commission of the City of Burlingame that:

BURLINGAME,CA 94010 WHEREAS, a categorical exemption has been proposed and application
has been made for special permits for an accessory structurefor
recreationalpurposes windows within ten feet of the side property line
and retention of a toilet and sink at 301 Bayswater Avenue APN 029-302-
050; property owner: Grea and Jennifer Cohn 301 Bayswater-Avenue; and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on June 13. 1994 at which time it reviewed and
considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
categorical exemption Section 15303 - New Construction or Conversion of
Small Structures Class 3(e) Accessory (appurtenant) structures including
garages, carports, patios, swimming pools and fences is hereby approved.
2. Said special permits are approved subject to the conditions set
forth in Exhibit IIA" attached hereto. Findings for such variance and
special permits are as set forth in the minutes and recording of said
meeting.
3. It is further directed that a certified copy of this resolution
be recorded in the officialrecordsof the County of San Mateo. -

Conditions of approval categorical exemption and special permits
301 Bayswater Avenue
effective June 20, 1994
1. that the project be built as shown on the plans submitted to the
Planning Department and date stamped May 11, 1994 Sheet A. 1, General
Site Plari and Floor Plan, with the windows adjacent to the side
property line inset 3 '-2" and the shower stall removed with the
plumbing for the shower removed from the wall;
2. that the conditions of the Fire Marshal's March 13 , 1989 memo, the
City Engineer's March 13 , 1989 memo and the Chief Building
Inspectors ' s March 14 , 1989 memo shall be met;
3 . that retroactive building permits shall be obtained for all work
done without permits and all penalty fees paid;
4 . that the structure shall be used as a recreation room/study and art
studio/dark room only and shall never be used for living purposes;
5. that the conditions of the Chief Building Official's memo dated May
16, 1994 , shall be met; and
6. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of
Burlingame.
