RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND VARIANCE
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, categorical exemption has been proposed and application has
been made for a variance to Floor Area Ratio at 340 Pepper Avenue, APN
028-311-190; property owner: Scott and Alexis Danielson, 1024 Cortez
Avenue; and
WHERLXS, said matters were heard by the Planning Commission of the
City of Burlingame on June 27, 1994 , at which time it reviewed and
considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
categorical exemption per Section 15303 - New Construction or conversion
of Small Structures Class 3(a) , Single-family residences not in
conjunction with the building of two or more such units is hereby
approved.
2. Said variance is approved subject to the conditions set forth
in Exhibit "A" attached hereto. Findings for such variance are as set
forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.

introduced and adopted at a regular meeting of the Planning Commission

Conditions of approval categorical exemption and variance
340 PEPPER AVENUE
effective JULY 5, 1994
1. that the project shall be built as shown on the plans
submitted to the Planning Department and date stamped June
15, 1994, Sheets SP-1, A-1, A-2 , A-5, A-6, A-8, and A-11;
2 . that the ceiling heights in the studio (572 SF) , living
room (347 SF) , dining room (247 SF) and master bedroom
(300 SF) shall not exceed 14 ' -0", 15 '-611 , 15 '-6" and 12 ' -
6" respectively;
3 . that the maximum height of the two story portion of the
house at the front of the lot shall be no greater than
30 ' -0" to the top of the finished material at the ridge
from elevation 50; and
4 . that the project shall meet all Uniform Building and
Uniform Fire Code requirements as amended by the City of
Burlingame.
