RESOLUTION NO . 39-94
RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND SPECIAL PERMIT
RESOLVED , by the Planning Commission of the City of Burlingame that :
WHEREAS , a categorical exemption has been proposed and application
has been made for a special permit for take out food at 1236
Burlingame Avenue . APN : 029 - 152 - 160 ; property owner : Brian Davis , 1236
Burlingame Avenue ; and
WHEREAS , said matters were heard by the Planning Commission of the
City of Burlingame on August 22 , 1994 , at which time it reviewed and
considered the staff report and all other written materials and testimony
presented at said hearing ;
NOW , THEREFORE , it is RESOLVED and DETERMINED by this Planning
Commission that :
1 . On the basis of the Initial Study and the documents submitted
and reviewed , and comments received and addressed by this commission , it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment , and
categorical exemption Section : 15301 - Existing Facilities , Class 1 ( a ) ,
Interior or exterior alterations involving such things as interior
partitions , plumbing , and electrical conveyances is hereby approved .
2 . Said special permit is approved subject to the conditions set
forth in Exhibit "A" attached hereto . Findings for such special permit
are as set forth in the minutes and recording of said meeting .
3 . It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo .

Burlingame , do hereby certify that the foregoing resolution was
introduced and adopted at a regular meeting of the Planning Commission
held on the 22nd day of August 1994 , by the following vote :

EXHIBIT "A"
Conditions of approval categorical exemption and special permit
1236 BURLINGAME AVENUE
effective SEPTEMBER 6, 1994
1. that the project shall be built as shown on the plans submitted to
the Planning Department and date stamped July 20, 1994 Store Floor
Plan (82" X 1411) and August 2, 1994 Sheet 1, General Structure Floor
Plan (1111 X 1711);
2. that the conditions of the City Engineers' August 8, 1994 memo shall
be met;
3. that the business will be open 9:00 A.M. to 7:00 P.M. Monday through
Saturday and 10:00 P.M. to 5:00 P.M. Sunday with a maximum of six
employees at any one time;
4. that the applicant shall provide and maintain at least daily, more
often if necessary, a trash receptacle at the door along Burlingame
Avenue, or at locations approved by the City Engineer and Fire
Department;
5. that the applicant shall remove once a day or more frequently, all
take out debris in front of the store and within 50' of the store;
and
6. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of
Burlingame.
