RESOLUTION NO. 44-94
RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND VARIANCE
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application
has been made for a variance to required average front setback where
26 '-0" is required and 18 '-6" is requested to the front porch at 950
Paloma Avenue, zoned R-1, APN: 026-221-210 ; property owner: Steve
Peterson, 950 Paloma ; and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on September 26, 1994 , at which time it reviewed and
considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
categorical exemption Section: 15303 - New Construction or Conversion of
Small Structures Class 3 (a) , Single-family residences not in conjunction
with the building of two or more such units is hereby approved.
2 . Said variance is approved subject to the conditions set forth
in Exhibit "A" attached hereto. Findings for such variance are as set
forth in the minutes and recording of said meeting.
3 . It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.

Burlingame, do hereby certify that the foregoing resolution was
introduced and adopted at a regular meeting of the Planning Commission
held on the 26th day of September , 1994 , by the following vote:

Conditions of approval categorical exemption and variance

effective OCTOBER 3, 1994
1. that the project shall be built as shown on the plans submit-
ted to the Planning Department and date stamped July 19, 1994,
Sheet A-1 and Front Setback Survey;
2. that the front setback to the front porch shall not be less
that 18 '-6" and that the front setback to the main house shall
not be less than 26 '-0" ;
3 . that the proposed fence elevation (Sheet A-1) shall not be
approved with this application and shall be redesigned to
conform to code prior to the issuance of a Building permit;
and
4. that the project shall meet all Uniform Building and Uniform
Fire Code requirements as amended by the City.
